K.P.RAVAL, APP for Respondent(s) : 1, \nNone for\nRespondent(s) : 2 - 3. \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent Petition has been filed by the Petitioner under Articles 14<br \/>\n\tand 227 of the Constitution of India for the prayer that the order<br \/>\n\tpassed by the learned Judge, Family Court, Junagadh, in Criminal<br \/>\n\tMisc. Application No.532 of 2010 (Old No.768 of 2009) filed by the<br \/>\n\tpresent Respondent No.2 &#8211; wife regarding maintenance under<br \/>\n\tSection 125 of the Criminal Procedure Code, may be quashed and set<br \/>\n\taside on the grounds stated in the memo of Petition.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. S.D.Suthar for learned Advocate Mr.<br \/>\n\tN.K.Majmudar for the Petitioner and learned APP Mr. K.P.Raval for<br \/>\n\tthe Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Suthar for the Petitioner made a feeble attempt to<br \/>\n\temphasize that without considering the income or evidence regarding<br \/>\n\tthe income of the Petitioner, Rs.8000\/- has been awarded towards the<br \/>\n\tmaintenance which is erroneous.  He submitted that the Petitioner<br \/>\n\thas been only working on a lathe and earning Rs.3000\/- per month,<br \/>\n\twhich has not been appreciated, and therefore, the order passed by<br \/>\n\tthe Family Court, Junagadh may be quashed and set aside.\n<\/p>\n<p>Though<br \/>\n\tthe submission has been made, as it transpires from the impugned<br \/>\n\torder itself that the Petitioner is doing the business and there is<br \/>\n\ta reference of partnership deed regarding the partnership between<br \/>\n\tthe Petitioner and his brother and \/ or father and there is a<br \/>\n\treference of two firms named as Pharma Mechanics at Morbi and Amba<br \/>\n\tMechanics. There is specific observation made by the Court below<br \/>\n\tthat such a defence that he was only working on a lathe and earning<br \/>\n\tRs.3000\/-, is raised to create such defence, which is not supported<br \/>\n\tby any evidence, and on the contrary, he has tried to conceal the<br \/>\n\tincome deliberately and the proof of income which is supposed to be<br \/>\n\tin his possession, he has placed on record nothing, and therefore,<br \/>\n\tpresumption should be made under Section 114(g) of the Evidence Act.\n<\/p>\n<p>Therefore,<br \/>\n\tin view of the discussions made by the Family Court regarding the<br \/>\n\tconduct of the Petitioner, the income  and his property, where it is<br \/>\n\tspecifically referred to his admissions in the cross-examination, no<br \/>\n\tcase is made out for any interference and exercise of discretion<br \/>\n\tunder Article 227 of the Constitution of India, and the present<br \/>\n\tPetition therefore deserves to be dismissed and accordingly stands<br \/>\n\tdismissed in limine.\n<\/p>\n<p>(Rajesh<br \/>\nH.
