DISTRICT ESTABLISHMENT COMMITTEE,\n                           BHOJPUR ARRAH THROUGH THE DISTRICT\n                           MAGISTRATE-CUM-COLLECTOR, ARRAH.\n                                       -----------\n<\/pre>\n<p>3   27\/09\/2010            Petitioner wants two benefits, first is second time<\/p>\n<p>                  bound promotion and the second is benefit of promotion<\/p>\n<p>                  under the Assured Career Progression scheme formulated<\/p>\n<p>                  for Class III &amp; IV employees which is Rule of 2003 and<\/p>\n<p>                  has been annexed as Annexure-3 to the writ application.<\/p>\n<p>                          Stand of the respondents is that the benefit of<\/p>\n<p>                  second time bound promotion stood withdrawn from<\/p>\n<p>                  1.1.1996. Petitioner completed 25 years of service on<\/p>\n<p>                  14.6.1998. Therefore, there was no occasion to give him<\/p>\n<p>                  the said benefit when the policy itself stood withdrawn<\/p>\n<p>                  before the eligibility of the petitioner accrued.<\/p>\n<p>                          So far as the benefit under the Rules of 2003 is<\/p>\n<p>                  concerned, stand of the respondents is that in terms of<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>        rule 4(5) of 2003 Rules, petitioner had to fulfill the<\/p>\n<p>        condition precedent for promotion in terms of section<\/p>\n<p>        157(3)(j)(b) of Board&#8217;s Misc. Rules. Since the petitioner<\/p>\n<p>        did not acquire the requisite eligibility at the relevant<\/p>\n<p>        time, this benefit too could not accrue to him. It is further<\/p>\n<p>        stated that now this issue is settled by the Full Bench<\/p>\n<p>        decision in the case of Maheshwar Prasad Singh and<\/p>\n<p>        others Vs. the State of Bihar and others contained in<\/p>\n<p>        Annexure-A.\n<\/p>\n<p>                In view of the above, the petitioner could not be<\/p>\n<p>        given any such benefit which he is claiming.
