Mr.Pujari for respondent no.1 and learned advocate<br \/>\nMr.Vaghela for respondent No.2.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent applicant has been convicted for the offence punishable under<br \/>\nSection 138 of the Negotiable Instruments Act, 1881 by judgment and<br \/>\norder dated 17.11.2009 in Criminal Case No.285 of 2008 passed by<br \/>\nlearned Metropolitan Magistrate, Negotiable Instrument Court No.6,<br \/>\nAhmedabad. The said order was challenged in appeal being Criminal<br \/>\nAppeal No.316 of 2009 before the learned Additional Sessions Judge,<br \/>\nAhmedabad. The said appeal is also dismissed by judgment and order<br \/>\ndated 11.12.2009. Both these orders are under challenge before this<br \/>\nCourt.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by learned advocate Mr.Y.B.Vaghela that he is appearing<br \/>\non behalf of the original complainant and he will file his<br \/>\nvakalatnama within three days. Office is directed to accept the<br \/>\nvakalatnama that may be filed by Mr.Vaghela.  Mr.Vaghela submitted<br \/>\nthat the matter is amicably settled between the original complainant<br \/>\nand the present appellant accused.  He placed on record the<br \/>\ncompromise purshis.  The complainant is personally present in the<br \/>\nCourt who is identified by Mr.Vaghela and Mr.Vaghela, on<br \/>\ninstructions, states that the matter is settled amicably between the<br \/>\nparties and the complainant has no grievance against the present<br \/>\nappellant accused and requested to permit them to compound the<br \/>\noffence.\n<\/p>\n<p>4.\t\tThe<br \/>\nApex Court in the case of Vinay Devanna Nayak V\/s Ryot Seva Sahakari<br \/>\nBank Ltd. reported in AIR 2008 SC 716 has observed as under in paras<br \/>\n17 and 18 of the judgment :\n<\/p>\n<p> 17.\tAs<br \/>\nobserved by this Court in <a href=\"\/doc\/979235\/\">Electronic Trade &amp; Technology<br \/>\nDevelopment Corporation Ltd. V. Indian Technologists and Engineers,<\/a><br \/>\n(1996) 2 SCC 739, the object of bringing Section 138 in the statute<br \/>\nbook is to inculcate faith in the efficacy of banking operation and<br \/>\ncredibility in transacting business on negotiable instruments. The<br \/>\nprovision is intended to prevent dishonesty on the party of the<br \/>\ndrawer of negotiable instruments in issuing cheques without<br \/>\nsufficient funds or with a view to inducing the payee or holder in<br \/>\ndue course to act upon it. It thus seeks to promote the efficacy of<br \/>\nbanking operations and ensures credibility in transacting business<br \/>\nthrough cheques. In such matters, therefore, normally compounding of<br \/>\noffences should not be denied. Presumably, Parliament also realized<br \/>\nthis aspect and inserted Section 147 by the Negotiable Instruments<br \/>\n(Amendment and Miscellaneous Provisions) Act, 2002 (Act 55 of 2002) .\n<\/p>\n<p>18.\t\tTaking<br \/>\ninto consideration even the said provision (Section 147) and the<br \/>\nprimary object underlying Section 138, in our judgment, there is no<br \/>\nreason to refuse compromise between the parties. We therefore dispose<br \/>\nof the appeal on the basis of the settlement arrived at between the<br \/>\nappellant and the respondent.\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the aforesaid decision of the Apex Court to the facts of<br \/>\nthe present case, I am of the opinion that the revision application<br \/>\nis required to be allowed and the parties be permitted to compound<br \/>\nthe offence.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result, the revision application is allowed. The judgment and<br \/>\norder 17.11.2009 passed in Criminal Case No.285 of 2008 by learned<br \/>\nMetropolitan Magistrate, Negotiable Instrument Court No.6, Ahmedabad<br \/>\nand the judgment and order dated 11.12.2009 passed in Criminal Appeal<br \/>\nNo.316 of 2009 by learned Additional Sessions Judge, Ahmedabad are<br \/>\nquashed and set aside. The accused is acquitted of the charge under<br \/>\nSection 138 of the Negotiable Instruments Act.\n<\/p>\n<p>7.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
