PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Mr. Shivang Shukla, learned APP, waives service of rule for the<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tThe present<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder sec. 439 of the Code of Criminal Procedure after the charge<br \/>\nsheet is filed.\n<\/p>\n<p>3.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 379, 411 and<br \/>\n114 of IPC, sec. 3 &amp; 7 of the Prevention of Damage to Public<br \/>\nProperty Act, 1984, sec. 3 &amp; 7 of the Essential Commodities Act,<br \/>\n1955 and sec. 15(2) of the Petroleum and Mineral Pipeline Act, 1962<br \/>\nfor which FIR, being C.R. No. I-26\/2010, has been registered with<br \/>\nAdalaj Police Station. Gandhinagar.\n<\/p>\n<p>4.\tLearned advocate Mr.<br \/>\nPathan referred to the FIR and submitted that he is not named in the<br \/>\nFIR and the other co-accused have been released by this court as per<br \/>\nthe order passed in Criminal Misc. Application No. 6303 of 2010 as<br \/>\nwell as Criminal Misc. Application No. 6598 of 2010. He further<br \/>\nsubmitted that as now the charge sheet has been field, the present<br \/>\napplication may be allowed.\n<\/p>\n<p>5.\tLearned APP Mr.<br \/>\nShukla resisted the application.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned advocate Mr. Pathan and learned APP Mr. Shukla and<br \/>\nhaving considered the nature of offence, the manner in which the<br \/>\noffence is alleged to have been committed, the role attributed and<br \/>\nalso considering the fact that the charge sheet is now filed, the<br \/>\npresent application deserves to be allowed.\n<\/p>\n<p>7.\tThe application is<br \/>\naccordingly allowed.  The applicant is ordered to be released on bail<br \/>\nin connection with C.R. No. I-26\/2010 registered with  Adalaj Police<br \/>\nStation, Gandhinagar on his executing a personal bond of Rs. 5,000\/-<br \/>\n(Rupees Five Thousand only) with one solvent surety for the like<br \/>\namount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till  the trial commences.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>8.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>9.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
