Respondents\n\n\nHabeas Corpus Petition filed under Article 226 of the Constitution of\nIndia directing the respondents to produce the petitioner's brother Lungheuneng\naged about 11 years before this Court and handover the custody to the\npetitioner.\n\n!For Petitioner    ... Mr.P.N.Pandidurai,\n\t\t       Addl.Public Prosecutor\n\t\t       for R1 to R3\n\n:ORDER\n<\/pre>\n<p>(Order of the Court was made by<br \/>\nRAJA ELANGO, J.)<\/p>\n<p>\tThe petitioner has approached this Court to direct the respondents to<br \/>\nproduce her brother by name Lungheuneng aged about 11 years  before this Court<br \/>\nand handover the custody to her.\n<\/p>\n<p>\t2. Learned counsel for the petitioner has submitted that the detenu along<br \/>\nwith other children are under the illegal custody of the third and fourth<br \/>\nrespondents.\n<\/p>\n<p>\t3. Learned Additional Public Prosecutor has submitted that the detenu is<br \/>\nnot under any illegal custody. He further submitted that, originally, the detenu<br \/>\nalong with 70 other persons were handed over to one Paul in Chennai, who was<br \/>\nrunning an orphanage and the said Paul, due to financial stress, forwarded the<br \/>\nchildren to one Shaji who is also running an orphanage at Kanyakumari. It is his<br \/>\nfurther submission that the District Social Welfare Officer, Kanyakumari<br \/>\nDistrict at Nagercoil, inspected the place and found that there was no proper<br \/>\ninfrastructure and that they are not running the said orphanage with proper<br \/>\nauthority. Hence, the detenu in the present HCP along with other persons were<br \/>\nrescued from the orphanage run by the said Shaji and they were taken to Madurai<br \/>\nand presently, the detenu along with other children were forwarded to their<br \/>\nnative places, with proper escort.\n<\/p>\n<p>\t4. In view of the above submission of the learned Additional Public<br \/>\nProsecutor, this Court is of the considered view that the action taken by the<br \/>\nDistrict Social Welfare Officer in rescuing the children from the orphanage,<br \/>\ndeserves to be appreciated. Also, in view of the stand taken by the respondents<br \/>\nherein, we find nothing survives in this Habeas Corpus Petition, but at the same<br \/>\ntime, the petitioner is at liberty to approach the concerned authority in the<br \/>\nnative place for custody of the detenu, by producing proper documents.\n<\/p>\n<p>\t5.
