2   18.04.2011             Heard learned Sr. counsels for the petitioners<\/p>\n
                 and the complainant.\n<\/p>\n
                           The petitioner being the father-in-law is<\/p>\n
                 apprehending his arrest in a complaint case in which<\/p>\n
                 cognizance has been taken under Sections 498A and<\/p>\n
                 304B of the Indian Penal Code and Sections 3 and 4 of<\/p>\n
                 the Dowry Prohibition Act, whereas, other petitioner<\/p>\n
                 being the husband, languishing in custody since<\/p>\n
                 05.12.2010, is seeking regular bail.<\/p>\n
                           The regular bail application of the husband<\/p>\n
                 has been placed before this Court in pursuance to the<\/p>\n
                 order dated 25.03.2011.\n<\/p>\n
                           The marriage was performed on 16.01.2001<\/p>\n
                 at Calcutta whereas, the victim died on 03.08.2001 at<\/p>\n
                 Patna. On 03.08.2001 itself, U.D. case was registered at<\/p>\n
                 the behest of the husband. Subsequently, the police
\n                  -2-<\/span><\/p>\n
found it a case of suicide and did not register a formal<\/p>\n
F.I.R. It appears that subsequently, the father of the<\/p>\n
victim filed a complaint at Calcutta, which was<\/p>\n
subsequently, registered as police case on 15.10.2001<\/p>\n
as Bidhannagar (North) P.S. Case No. 155 of 2001 in<\/p>\n
which the final form was submitted as mistake of law.<\/p>\n
It appears that the Calcutta police found that it has no<\/p>\n
jurisdiction to investigate the case. Hence, the<\/p>\n
S.D.J.M., Barrackpur discharged the accused persons<\/p>\n
vide order dated 26.03.2003 as contained in Annexure-<\/p>\n
4.<\/p>\n
          It is submitted by learned Sr. counsel for the<\/p>\n
petitioner that the police found the case of suicide,<\/p>\n
hence, the formal F.I.R. was not registered and the<\/p>\n
present complaint has been filed after three months of<\/p>\n
the occurrence when the dead body, after postmortem,<\/p>\n
was received by the complainant himself on 04.08.2001<\/p>\n
when the complainant took it to Calcutta. It is<\/p>\n
submitted that when the accusation made by the<\/p>\n
complainant, was found not true at Calcutta then the<\/p>\n
present case was lodged.\n<\/p>\n

            It is further submitted that only husband and<\/p>\n
wife were present when the occurrence took place as<\/p>\n
father-in-law was not present which has not been<\/p>\n
controverted     by     learned   Sr.   counsel   for   the<\/p>\n
complainant.\n<\/p>\n
            Learned Sr. counsel for the complainant<\/p>\n
submits that in Calcutta case, the anticipatory bail<\/p>\n
application of the father-in-law and mother-in-law was<\/p>\n
rejected.\n<\/p>\n
            It is submitted on behalf of the petitioners<\/p>\n
that the same order reflects that the husband and<\/p>\n
brother of the husband were granted anticipatory bail.<\/p>\n
Moreover, the Calcutta case was ended into discharge<\/p>\n
by order passed by learned S.D.J.M., Barrackpur, West<\/p>\n
Bengal.\n<\/p>\n
            The further contention of the learned Sr.<\/p>\n
counsel for the complainant is that the accused persons<\/p>\n
evaded to appear since last several years on one pretext<\/p>\n
or the other and did not allow the trial to commence..<\/p>\n
            Learned Sr. counsel for the petitioner<\/p>\n
submits that the matter with regard to the quashing of
\n                   -4-<\/span><\/p>\n
the order of cognizance as well as applications under<\/p>\n
Section 205 Cr.P.C. were pending, as a result of which,<\/p>\n
they could not appear and non-bailable warrant has<\/p>\n
been issued for the first time on 07.09.2010.<\/p>\n
            The further contention of learned Sr. counsel<\/p>\n
for the complainant is that in spite of direction of the<\/p>\n
S.P., the U.D. case was not converted into regular<\/p>\n
F.I.R., the submission has no meaning since the<\/p>\n
outcome of U.D. Case has not been challenged by the<\/p>\n
complainant.\n<\/p>\n
            Considering lodging of the complaint after<\/p>\n
three months of the occurrence, the fact that the father-<\/p>\n
in-law was not present in Patna when the occurrence<\/p>\n
took place, the suicidal note of the victim, as contained<\/p>\n
in Annexure- 3, reflects that the victim did not allege<\/p>\n
anything against the accused persons rather has taken<\/p>\n
responsibilities of committing suicide on her own, and<\/p>\n
the husband was granted anticipatory bail by Calcutta<\/p>\n
court let    the petitioner   namely Balaram      Poddar<\/p>\n
(father-in-law), be released on anticipatory bail, in<\/p>\n
the    event      of    his    arrest    or     surrender

             before the learned Court below within a period of 12<\/p>\n
             weeks from today, on furnishing bail bond of Rs.<\/p>\n
             10,000\/- (ten thousand) with two sureties of the like<\/p>\n
             amount each to the satisfaction of the learned Sub-<\/p>\n
             divisional Judicial Magistrate, Patna in connection with<\/p>\n
             Complaint Case No.        2105C\/2001, subject to the<\/p>\n
             conditions as laid down under Section 438(2) Cr.P.C.<\/p>\n
                        Let the petitioner namely, Chiranjib Poddar<\/p>\n
             (husband) be released on regular bail on furnishing bail<\/p>\n
             bond of Rs. 10,000\/- (ten thousand) with two sureties<\/p>\n
             of the like amount each to the satisfaction of the<\/p>\n
             learned S.D.J.M., Patna in connection with Complaint<\/p>\n
             Case No. 2105C\/01.\n<\/p>\n
                        The learned court below will be at liberty to<\/p>\n
             cancel the bail of the petitioners positively, if the<\/p>\n
             petitioners fail to appear on three consecutive occasions<\/p>\n
             during the trial.\n<\/p>\n
                        It is expected from the learned court below to<\/p>\n
             make the commitment of the case within a period of<\/p>\n
             one month, when the trial court will expedite the trial.<\/p>\n
