SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/01\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tPresent<br \/>\napplication has been preferred by the applicant &#8211; original<br \/>\nappellant &#8211; acquiring body &#8211; Videocon Narmada Electronics<br \/>\nLimited for the interim relief to stay further execution,<br \/>\nimplementation and operation of the judgment and award passed by the<br \/>\nlearned Additional District Judge, Bharuch in Land Reference Case<br \/>\nNo.401\/1999 till the final disposal of the main Appeal.\n<\/p>\n<p>2.\tThough<br \/>\nserved, nobody appears on behalf of respondent No.3\/1 and to 3\/2 &#8211;<br \/>\noriginal claimants.  Shri Neeraj Soni, learned Assistant Government<br \/>\nPleader has appeared on behalf of respondent Nos.1 and 2.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Kinariwala, learned advocate appearing on behalf of the<br \/>\napplicant &#8211; original opponent and Shri Neeraj Soni, learned AGP<br \/>\nappearing on behalf of respondent Nos.1 and 2 and considering the<br \/>\nfact that main First Appeal is admitted, in the facts and<br \/>\ncircumstances of  the case, ad-interim relief in terms of paragraph<br \/>\n4(B) on condition that the applicant &#8211; original appellant shall<br \/>\ndeposit the entire amount as awarded by the Reference Court within a<br \/>\nperiod of eight weeks from today.  On such deposit, claimant shall be<br \/>\nentitled to withdraw 25% of the amount without furnishing security<br \/>\nand further 25% of the amount so awarded on furnishing security to<br \/>\nthe satisfaction of the Reference Court.  Reference Court is directed<br \/>\nto invest balance 50% of the amount together with interest and cost<br \/>\nin fixed deposit in the name of Nazir initially for a period of five<br \/>\nyears with cumulative interest and continue to renew the same from<br \/>\ntime to time as and when matured.  The fixed deposit shall be kept<br \/>\nwith the Registry.
