He submitted that the matter assumes<br \/>\ngreatest significance in light of the fact that the Probate<br \/>\nApplication No. 43 of 2006 and the application exh. 14 filed by the<br \/>\nplaintiffs of the suit is fixed for hearing on 14th May<br \/>\n2010.  He submitted that after expiry of about four years, the suit<br \/>\nis filed only with a view to see that the plaintiffs of that suit are<br \/>\nable to obtain orders at the back of the petitioner by getting an<br \/>\nex-parte order of appointment of Commissioner.\n<\/p>\n<p>2.2\tThe<br \/>\nlearned advocate for the petitioner submitted that if status quo, as<br \/>\non today, is not ordered that will prejudice the rights of the<br \/>\npetitioner and will also render the hearing of the Probate<br \/>\nApplication No. 43 of 2006 and exh. 14 application adversely<br \/>\naffected.  The learned advocate for the petitioner submitted that the<br \/>\nfact that the plaintiffs of new suit i.e. Special Civil Suit<br \/>\nNo.\n<\/p>\n<p>23 of 2010, though in know of an order passed by this Court dated<br \/>\n30th November 2009, is not brought to the notice of the<br \/>\nCourt shows their ill design and oblique motive.\n<\/p>\n<p>3.0\tThe<br \/>\nmatter requires consideration.  Hence, Rule.\n<\/p>\n<p>3.1\tNotice<br \/>\nas to Interim Relief returnable on 15th<br \/>\nJune 2010.\n<\/p>\n<p>Ad-interim relief in terms of Para 9(C).<br \/>\n Direct service is permitted today.\n<\/p>\n<p>[<br \/>\nRavi R.
