SHARMA, J (ORAL)<\/p>\n<p>CM No. 7428-CI of 2009<\/p>\n<p>         This application under Section 5 of the Limitation Act has<\/p>\n<p>been moved for condoning the delay of 47 days in filing the appeal.<\/p>\n<p>         It has been averred in the application, that the delay of 47 days<\/p>\n<p>has occurred due to procedural requirements, which were required to be<\/p>\n<p>followed for filing of appeal. It has also been averred that the delay<\/p>\n<p>further occurred due to the fact that the funds had to be arranged for<\/p>\n<p>filing of this appeal, which took some time.         The application is<br \/>\n RFA No. 2630 of 2009 (O&amp;M)<br \/>\n<span class=\"hidden_text\">                                                                      -2-<\/span><\/p>\n<p>supported by an affidavit.\n<\/p>\n<p>          Learned counsel for the respondent does not oppose the<\/p>\n<p>application for condonation of delay in filing the appeal.<\/p>\n<p>          For the reasons stated in the application, C.M. is allowed and<\/p>\n<p>the delay of 47 days in filing the appeal is condoned.<\/p>\n<p>RFA No. 2630 &amp; CM No. 7429-CI of 2009<\/p>\n<p>          It has been pointed out, that this appeal is squarely covered by<\/p>\n<p>the decision of this Court in RFA No. 663 of 2004 decided on 2.8.2006.<\/p>\n<p>The order passed by this Court reads as under: &#8211;<\/p>\n<blockquote><p>          &#8220;After hearing the counsel for the parties, I am of the<br \/>\n          considered opinion that as the land in the present case<br \/>\n          was acquired in village Nizampur, Burail and village<br \/>\n          Jhumru, and as both these villages were not within the<br \/>\n          municipal limit of Chandigarh and hence, no<br \/>\n          permission was required for raising any construction.<br \/>\n          It has come in evidence that the claimants had raised<br \/>\n          construction and, therefore, the      compensation for<br \/>\n          super structures has to be assessed. In RFA No. 260-8<br \/>\n          of 1980 titled as Dharam Vir etc. Vs. The Union of<br \/>\n          India and RFA No. 894 of 1976 titled as Hans Raj etc.<br \/>\n          versus Chandigarh Administration, this Court has held<br \/>\n          that even if the construction was unauthorised, still in<br \/>\n          view of the definition of the land as given in Section 3\n<\/p><\/blockquote>\n<blockquote><p>          (a) of the Act, the owner would be entitled for the<br \/>\n          compensation of the same.         Thus, the Additional<br \/>\n          District Judge, vide impugned Award, has rightly<br \/>\n          enhanced the compensation by 15% over and above<br \/>\n          what was assessed by the Land Acquisition Collector.<\/p><\/blockquote>\n<p>          The contention of the counsel for the claimants that as<br \/>\n          they had purchased the raw material from retail shops,<br \/>\n          therefore, some more enhancement should be granted,<br \/>\n RFA No. 2630 of 2009 (O&amp;M)<br \/>\n<span class=\"hidden_text\">                                                                    -3-<\/span><\/p>\n<p>         could not be accepted as well. There is no cogent<br \/>\n         evidence led which can suggest that the raw material<br \/>\n         was purchased from retail shops. The claimants have<br \/>\n         already been given enhancement in the valuation of the<br \/>\n         super structures.\n<\/p>\n<p>         As far as the valuation of the trees, tubewells etc. are<br \/>\n         concerned, the reference court has already been<br \/>\n         granted enhancement 162% on the basis of the official<br \/>\n         of the respondent.     The enhancement made by the<br \/>\n         Additional District Judge, Chandigarh is just and fair<br \/>\n         and calls for no interference.\n<\/p>\n<p>         In view of the above, the appeals filed by the U.T.<br \/>\n         Chandigarh as well as by the claimants, are<br \/>\n         dismissed.&#8221;\n<\/p>\n<p>         The matter being squarely covered, this appeal is liable to be<\/p>\n<p>dismissed.
