Purnima &amp; Ors.)\n\n                        DATE OF ORDER<\/a> : 5\/12\/2008\n\n\n               HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.L.K.Purohit, for the appellant.\nMr.S.N.Pungalia, for the respondents.\n\n\n\n1.      Heard learned counsels.\n\n2.      Learned counsel for the appellant submits that though the first\n\nappellate court had ordered on 15\/11\/2008 that the application under\n\nOrder 41 Rule 27 CPC would be considered at the time of final\n\nhearing of the appeal but the said application escaped the notice of\n\nfirst appellate court and first appellate court did not decide the said\n\napplication before deciding the appeal itself.\n\n3.      He submitted that in the said application the defendant had\n\nsubmitted that one shop had become available to the plaintiff\n\nrespondents for satisfaction of their personal need and same was\n\ngiven to another tenant known as `Yash Collection'. Though reply to\n\nthe said application was filed by the plaintiff respondents, however,\n\nin the absence of said application being decided, no evidence was\n\nbrought before the Court as to whether the said shop became\n S.B.C.S.A NO. 273\/2008-<a href=\"\/doc\/699232\/\">L.Rs of Om Prakash vs. Smt. Purnima &amp; Ors.   Order<\/a> dt:5\/12\/2008\n\n                                           2\/2\n\n\navailable to the plaintiff respondents for their use or the already\n\nexisting tenant has changed the name of business and continued in the\n\nsame premises. This has caused prejudice to the appellant defendants\n\nby non consideration of the application.\n\n4.      Learned counsel for the appellant relied upon the decision of\n\nHon'ble Supreme Court in case of <a href=\"\/doc\/256898\/\">Hakam Singh &amp; Anr. vs. State of\n\nHaryana &amp; Ors.<\/a> - 2008 AIR SCW 5042, wherein, the Hon'ble Apex\n\nCourt has held that the application under Order 41 Rule 27 CPC is\n\nrequired to be considered before the decision of the appeal and thus\n\nthe appeal decided without consideration of said application under\n\nOrder 41 Rule 27 CPC is required to be set aside.\n\n5.      Consequently, this appeal is allowed and the order of the first\n\nappellate court dated 22\/7\/2008 is set aside and appeal is restored to\n\nthe said appellate court for consideration of appeal afresh after\n\ndecision of application under Order 41 Rule 27 CPC.
