Basheer, J.\n                  ------------------------------------------\n                         W.A.No.2377 of 2009\n                  ------------------------------------------\n              Dated this the 3rd day of November, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>S.R.Bannurmath, C.J.\n<\/p>\n<p>             Challenging the judgment of the learned Single Judge<\/p>\n<p>dated 17th August, 2009 in W.P.(C) No.3841 of 2009, directing the<\/p>\n<p>first respondent Kerala State Electricity Board to reconsider the<\/p>\n<p>demand made to the appellant Municipality for payment of the<\/p>\n<p>balance amount towards electrical energy consumed by the<\/p>\n<p>beneficiary committee for supply of drinking water, the present writ<\/p>\n<p>appeal is filed.\n<\/p>\n<p>             2. Taking into consideration the undisputed fact that the<\/p>\n<p>contract for supply of electrical energy is between the first<\/p>\n<p>respondent and the appellant Municipality and merely because it has<\/p>\n<p>entered into an agreement with the beneficiary committee,         that<\/p>\n<p>prima facie, does not absolve the appellant&#8217;s liability to pay the<\/p>\n<p>electricity charges. However, as the appellant\/petitioner has raised<\/p>\n<p>W.A.No.2377 of 2009\n<\/p>\n<p>                                &#8211; 2 &#8211;\n<\/p>\n<p>certain questions regarding limitation and discontinuation of the<\/p>\n<p>Scheme, the learned Single Judge, in our view, has rightly directed<\/p>\n<p>the first respondent Board to examine both the aspects and take a<\/p>\n<p>decision in accordance with law.\n<\/p>\n<p>            3. As such, considering the arguments once again, we<\/p>\n<p>do not find any illegality in the impugned order passed by the<\/p>\n<p>learned Single Judge.
