As the grounds of detention, one offence<br \/>\nhas been shown as registered against the detenu which pertains to<br \/>\n&#8216;immoral trafficking&#8217;.\n<\/p>\n<p>2.1\t\tLearned<br \/>\n Advocate has stated that on the basis of aforesaid single offence,<br \/>\nthe detaining authority came to the conclusion that the detenu was<br \/>\nimmoral traffic offender within the meaning of  Section 3(1)of the<br \/>\nPASA Act.  It was also stated in the impugned order that as the said<br \/>\nactivities of the detenu are dangerous and affecting maintenance of<br \/>\n&#8216;public order&#8217;, order of detention has been passed against him.\n<\/p>\n<p>2.2\t\tIn<br \/>\nsupport of his case,  learned advocate has placed reliance on a<br \/>\ndecision of this Court in the case of  <a href=\"\/doc\/1447427\/\">Vahidbhai Saiyadbhai<br \/>\nSheikh v. State of Gujarat &amp; Ors<\/a>  reported in 2003(3)<br \/>\nGLH 697 wherein at Para-9<br \/>\nit has been held as under:\n<\/p>\n<p> 9.\t\tStrikingly,<br \/>\nin this case, the authority did not choose even to file prosecution<br \/>\nand the question of detenu being released on bail could be considered<br \/>\nwhen prosecution is filed and some material is placed before the<br \/>\ndetaining authority that the detenu was likely to be released on<br \/>\nbail.  The detaining authority, in this case, instead has chosen to<br \/>\nrely upon an incident and from the said incident, the detaining<br \/>\nauthority reached to subjective satisfaction that the detenu was<br \/>\nlikely to continue his activities in future when there was no<br \/>\nmaterial at all on record revealing such repeating tendency on the<br \/>\npart of the detenu. The order of detention, therefore, is vitiated by<br \/>\nvice of non-application of mind.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned Counsel for the parties and   perused the documents placed on<br \/>\nrecord. I have  also considered factual and legal aspects emerging<br \/>\nfrom the record of the petition and the rival submissions. In the<br \/>\ncase on hand, the only material is one offence registered against the<br \/>\ndetenu which pertains to &#8216;immoral trafficking&#8217;.   Registration of a<br \/>\nsolitary offence is not sufficient material to infer a certain<br \/>\nhabit of the detenu and that on the basis of solitary registered<br \/>\noffence it would be far fetching to draw inference that the detenu<br \/>\nwas likely to commit such crimes again and again.<br \/>\nI am, therefore, of the view that the detaining Authority has passed<br \/>\nthe order of detention without there being any credible or cogent<br \/>\nmaterial on record in this behalf. Even, taking into consideration,<br \/>\nfacts and circumstances of the case and allegations made against the<br \/>\ndetenu it can be, at the most, said that there is disturbance of only<br \/>\n&#8216;law and order&#8217; and not &#8216;public order&#8217;.\n<\/p>\n<p>3.1\t\tHence,<br \/>\nin view of the above discussion as well as in view of the decision of<br \/>\nthis Court in the case of  Vahidbhai Saiyadbhai<br \/>\nSheikh (Supra),<br \/>\nthis Court is of the opinion that the order of detention deserves to<br \/>\nbe quashed and set aside.\n<\/p>\n<p>4.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 11.2.2010<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
