The suit was partly decreed, where the mandatory<br \/>\ndirection sought by the appellant-plaintiff was refused, but a<br \/>\ndeclaration was given to the effect that allotment of licence to<br \/>\nMohammed Hussain Bachubhai was not in accordance with law and,<br \/>\ntherefore, the same be ordered to be set aside.\n<\/p>\n<p>1.1\t\tThe<br \/>\nsaid decree was challenged by the respondents by preferring Regular<br \/>\nCivil Appeal No.100 of 2000 in the District Court, at Bhavnagar,<br \/>\nunder Section 96 of the Code of Civil Procedure.  By judgment and<br \/>\ndecree dated 28th September, 2004, the District Court<br \/>\nallowed the appeal and set aside the judgment and decree of the Trial<br \/>\nCourt.\n<\/p>\n<p>1.2\t\tThe<br \/>\npresent appellant-original plaintiff had not challenged that part of<br \/>\nthe decree which had gone against him nor had he preferred any<br \/>\ncross-objections.\n<\/p>\n<p>2.\t\tAggrieved<br \/>\nby the said judgment and decree of the District Court, present Second<br \/>\nAppeal is preferred and following questions are suggested as<br \/>\nsubstantial questions of law in the memo of appeal :-\n<\/p>\n<p>(1)\tWhether the<br \/>\nimpugned judgment and decree dated 28.9.2004 by the learned Joint<br \/>\nDistrict Judge, Fast Track Court No.3, Bhavnagar, in Regular Civil<br \/>\nAppeal No.100 of 2001 is in consonance with the evidence on record<br \/>\nand in accordance with the policy of the respondent Government?\n<\/p>\n<p>(2)\tWhether the<br \/>\nimpugned judgment and decree dated 28.9.2004 passed by the learned<br \/>\nJoint District Judge, Fast Track Court No.3, Bhavnagar, in Regular<br \/>\nCivil Appeal No.100 of 2001 is just, proper and in accordance with<br \/>\nlaw?\n<\/p>\n<p>None<br \/>\nof the two questions can be treated as substantial questions of law<br \/>\nand the appeal must fail only on this count.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate, Mr. Vyas, has raised several contentions on the aspect that<br \/>\nit is not established that Mohammed Hussain Bachubhai belong to Baxi<br \/>\nPanch category, whereas the petitioner fall into the relevant<br \/>\ncriteria of Physically Handicapped Person and that he was the only<br \/>\ncandidate eligible to be considered for allotment of licence for<br \/>\nrunning fair price shop.\n<\/p>\n<p>4.\t\tAs<br \/>\ncan be seen, the first factor that might come in the way of the<br \/>\nappellant is that the suit is filed without issuance of notice under<br \/>\nSection 80 of the Code of Civil Procedure.  Further, it would also be<br \/>\nrelevant to note, as can be seen from the judgment of the Appellate<br \/>\nCourt, that, while passing the decree of declaration and setting<br \/>\naside the allotment of licence, the Trial Court  overlooked the<br \/>\naspect that the affected party, namely, Mohammed Hussain Bachubhai,<br \/>\nwas not a party to the suit.  It also appears that the First<br \/>\nAppellant Court also noticed that the advertisement inviting<br \/>\napplications containing conditions was not forming part of the<br \/>\nrecord.  Against this, it is indicated that the conditions were<br \/>\nplaced on record at Exh.35.  Be that as it may, even if that is so,<br \/>\nit would again be a question involving facts and cannot be termed as<br \/>\na neat question of law calling for consideration by this Court in<br \/>\nexercise of powers under Section 100 of the Code of Civil Procedure.<br \/>\nIt is also relevant to note that the appellant had not produced his<br \/>\ncertificate of physical impairment along with the application but he<br \/>\nproduced it at a later point of time, after receiving letter from the<br \/>\nrespondent authorities.\n<\/p>\n<p>5.\t\tAll<br \/>\nthe factors considered, in the opinion of this Court, the appeal must<br \/>\nfail and is dismissed.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the dismissal of the appeal, no order on Civil Application.\n<\/p>\n<p>\t\t\t\t\t\t[<br \/>\nA.
