M.S.SHAH)<\/p>\n<p>\tThis<br \/>\nappeal under Clause 15 of the Letters Patent is directed against the<br \/>\norder dated 16th May, 2008 passed by the learned Single<br \/>\nJudge in so far as the learned Single Judge has passed interim order<br \/>\ndirecting the appellant \u00fd  State Trading Corporation of India to<br \/>\nreturn the entire amount of Rs.300 lakhs to the respondent No.2 \u00fd<br \/>\nPunjab National Bank, which the appellant had obtained by invoking<br \/>\nthe bank guarantees given by the respondent No.1 (original<br \/>\npetitioner) in favour of the appellant \u00fd  State Trading Corporation<br \/>\nof India in 2006. The learned Single Judge further directed the<br \/>\nrespondent No.2 &#8211; Bank to keep the amount with itself and to see that<br \/>\nthe amount earns interest at the maximum rate available to any<br \/>\nprivate depositor.\n<\/p>\n<p>2.\tAfter<br \/>\nthe matter being heard for some time, Shri S.M.Shah, learned counsel<br \/>\nfor the respondent No.2 (original petitioner) has submitted that the<br \/>\npetition is already admitted and fixed for final hearing and the<br \/>\noriginal petitioner has no objection if the interim order dated 16th<br \/>\nMay, 2008 passed by the learned Single Judge is set aside so that the<br \/>\npetition can be finally heard by the learned Single Judge without any<br \/>\npendency of the present appeal against the interim order.\n<\/p>\n<p>3.\tShri<br \/>\nR.K.Anand, learned Senior Counsel with Shri M.R.Bhatt for the<br \/>\nappellant \u00fd  State Trading Corporation of India could have no<br \/>\nobjection if this course of action is being adopted so long as the<br \/>\ninterim order passed by the learned Single Judge on 16th<br \/>\nMay, 2008 does not survive.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, we allow this appeal and set aside the interim<br \/>\norder dated 16th May, 2008 without disturbing the order of<br \/>\nthe learned Single Judge issuing Rule on the petition.\n<\/p>\n<p>5.\tAppeal<br \/>\nis accordingly allowed in the aforesaid terms.\n<\/p>\n<p>6.\tIt<br \/>\nis clarified that concession given by the learned Counsel for the<br \/>\nrespondent No.1 \u00fd  original petitioner is without prejudice to the<br \/>\nrights and contentions of the original petitioner which may be raised<br \/>\nat the time of final hearing of the petition and at the final hearing<br \/>\nof the petition, the learned Single Judge will be at liberty to<br \/>\ndecide the petition in accordance with law without being influenced<br \/>\nby this order.\n<\/p>\n<p>7.\tSince<br \/>\nthe Letters Patent Appeal is allowed, consequently, Civil<br \/>\nApplications for stay and production of additional evidence<br \/>\nrespectively  also stand disposed of.\n<\/p>\n<p>\t(<br \/>\nM.S.SHAH, Actg.C.
