          Petitioner is the second accused<\/p>\n
in  crime   No.104\/1996                  of        Fort  Police<\/p>\n
Station. Based on Annexure-D final report<\/p>\n
cognizance was taken for                 the offence under<\/p>\n
Sections 384, 411 and 413 read with Section<\/p>\n
34 of Indian Penal Code                    in C.P.144\/1996.<\/p>\n
As  the petitioner was absconding, case as<\/p>\n
against  him was split                    up and       case as<\/p>\n
against accused 1 and 3 were committed                       to<\/p>\n
Sessions court. Learned Sessions Judge took<\/p>\n
the case on the file as S.C.340\/1997 and<\/p>\n
made   it over          for           trial to           first<\/p>\n
Additional    Assistant                  Sessions        Judge,<\/p>\n
Thiruvananthapuram. By Annexure-E                      judgment<\/p>\n
dated   31\/10\/2010,              third            accused   was<\/p>\n
Crmc 453\/10              2<\/span><\/p>\n
acquitted after splitting the case as against<\/p>\n
the first accused who by that time absconded.<\/p>\n
Petition is filed    under Section 482 of Code of<\/p>\n
Criminal Procedure to quash the case against<\/p>\n
the     petitioner  contending  that   there   is<\/p>\n
absolutely no material to establish the offence<\/p>\n
alleged against him and entire evidence was<\/p>\n
recorded     in S.C.340\/1997 and apart from the<\/p>\n
evidence of PW4, the victim, there was no<\/p>\n
evidence in support of the prosecution and   PW4<\/p>\n
is now no more and in such circumstances, even<\/p>\n
if petitioner is to be tried there is no<\/p>\n
likelihood    of   a  conviction  and   in   such<\/p>\n
circumstances, the case is to be quashed.<\/p>\n
           2. Learned counsel appearing for the<\/p>\n
petitioner and learned Public Prosecutor were<\/p>\n
heard.\n<\/p>\n
           3. Annexure-D final report shows that<\/p>\n
prosecution case    is that on 6.1.2010 at about<\/p>\n

1.20 p.m, petitioner along with first accused<\/p>\n
asked      Nazar,  who was   examined as   PW4  in<\/p>\n
S.C.340\/1997 while standing in front of Ajantha<\/p>\n
theatre, East Fort whether he had seen the film<\/p>\n
Theeram Leela and thereafter took him       in an<\/p>\n
autorickshaw to the western side of National<\/p>\n
Highway at Kallummoodu junction and disclosing<\/p>\n
that Sunil was not there and he would come in<\/p>\n
front of Ajantha theatre         on the next day<\/p>\n
wanted him to hand over the gold chain and when<\/p>\n
he refused, first accused took out a chopper<\/p>\n
and threatened       him to part with gold chain<\/p>\n
weighing 5.500 ml. worth Rs.3,000\/- and took<\/p>\n
away gold chain and thereafter gold chain was<\/p>\n
handed over by the accused       1 and 2   to the<\/p>\n
third      accused  who  received  the  same  with<\/p>\n
knowledge that it is the       stolen property and<\/p>\n
thereby      committed  the  offences.  Annexure-D<\/p>\n
final report shows that the only witness who<\/p>\n
Crmc 453\/10               4<\/span><\/p>\n
was cited     to speak against the petitioner  or<\/p>\n
the part played by the petitioner, is the said<\/p>\n
Nazar. Though recovery of the gold chain was<\/p>\n
made, it was from the first accused. Hence even<\/p>\n
if that recovery is accepted it would only<\/p>\n
connect first accused with the offence and not<\/p>\n
he petitioner. No other witness was cited to<\/p>\n
show that petitioner was     there along with the<\/p>\n
first accused. It is on this basis, learned<\/p>\n
counsel appearing for the       petitioner argued<\/p>\n
that even if, petitioner is to be       tried, it<\/p>\n
would only be a futile exercise submitting that<\/p>\n
said Nazar, who is cited as CW1 is no more.<\/p>\n
           4. Learned Public Prosecutor submitted<\/p>\n
that      he was instructed that CW1 Nazar is now<\/p>\n
no more.\n<\/p>\n
           5. In such circumstances, question is<\/p>\n
when there is absolutely no material as against<\/p>\n
the petitioner, is he to be directed to stand<\/p>\n
Crmc 453\/10             5<\/span><\/p>\n
for trial, especially   when third accused  now<\/p>\n
stands acquitted. When there is absolutely no<\/p>\n
material to establish that petitioner committed<\/p>\n
any of the offences alleged and it is clear<\/p>\n
that consequent to the death of CW1 Nazar, even<\/p>\n
if, petitioner is to be tried, there is no<\/p>\n
likelihood of a successful prosecution, it is<\/p>\n
not in the interest of justice to continue the<\/p>\n
prosecution.\n<\/p>\n
           In such circumstances, petition   is<\/p>\n
allowed. L.P.115\/1997 in C.P.114\/96 on the file<\/p>\n
of     Judicial   First  Class   Magistrate-II,<\/p>\n
Thiruvananthapuram      as     against      the<\/p>\n
petitioner\/second accused is quashed.<\/p>\n
