PATTANAIK (J)\nRAMASWAMY, K.\n\nCITATION:\n 1996 AIR 1994\t\t  JT 1996 (5)\t135\n 1996 SCALE  (4)335\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nPATTANAIK, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by Special  leave is\tdirected against the<br \/>\njudgment of the Bombay High Court dated 3.9.93 inter alia on<br \/>\nthe ground  that the  High Court  committed gross  error  in<br \/>\nrelying upon  the order of the Chief Executive Officer dated<br \/>\n18.4.90 even  though the  said Chief  Executive Officer\t has<br \/>\nsuspended the  operation of  his earlier  order by his order<br \/>\ndated 26.10.1990. The short facts necessary for adjudicating<br \/>\nthe point  in issue are that respondents 1 to 4 were serving<br \/>\nunder  Zilla   Parishad\t as   Primary  School\tTeachers  on<br \/>\ndeputation between  1962-1968 and  were finally\t absorbed in<br \/>\nthe services  of Zilla\tParishad in  the year  1968-69.\t The<br \/>\nState of  Maharashtra, respondent no. 5, issued a Resolution<br \/>\nno.PTP. 1070-F dated 22nd October 1970 authorizing the Zilla<br \/>\nParishads, authorized Municipalities in Western Maharashtra,<br \/>\nthe Nagpur  Municipal Corporation and the Municipal Councils<br \/>\nin Nagpur  Division to upgrade the existing posts of primary<br \/>\nschool teachers\t on their respective establishments into the<br \/>\nposts of Head Masters in the scale of pay of Rs.145-250 with<br \/>\nretrospective effect  from 1st\tApril 1966. It was, however.<br \/>\nstated in the said Resolution that the number of posts to be<br \/>\nupgraded in each Zilla Parishad should be equal to the total<br \/>\nof the\tnumber of primary school teachers upto and inclusive<br \/>\nof Standard VII and other primary schools having 200 or more<br \/>\npeople on  their rolls\ton 1st\tApril, 1966.  The Resolution<br \/>\nalso stipulated\t that the  Zilla Parishads,  the  authorized<br \/>\nMunicipalities,\t the   Nagpur  Municipal   Corporation\t and<br \/>\nMunicipal Councils in Nagpur Division should be requested to<br \/>\nfix the\t number of  posts  of  Head  Masters  on  the  basis<br \/>\nindicated above on 1st April, 1966 for the first time and to<br \/>\nsubsequently review  it annually on 1st April. The aforesaid<br \/>\nResolution further indicated that the Zilla Parishads should<br \/>\nbe requested  to fill  up  the\tposts  of  Head\t Masters  by<br \/>\npromotion in  accordance with  the provisions  of Rule\t6(4)<br \/>\nread with  item No.  8 in Appendix IV (Part II) to Rule 5 of<br \/>\nthe   Maharashtra    Zilla   Parishads\t District   Services<br \/>\n(Recruitment) Rules,  1967 (hereinafter\t referred to as &#8220;the<br \/>\nRecruitment Rules&#8221;).  The relevant  Resolution is  extracted<br \/>\nhereinbelow in extenso:\n<\/p>\n<blockquote><p>     &#8221;\t  RESOLUTION.&#8211;Government     is<br \/>\n     pleased   to authorise   the  Zilla<br \/>\n     Parishads,\t\t      authorized<br \/>\n     Municipalities\t in\t Western<br \/>\n     Maharashtra, the\tNagpur Municipal<br \/>\n     Corporation   and\t the   Municipal<br \/>\n     Councils in  Nagpur  Division    to<br \/>\n     upgrade   the existing    posts  of<br \/>\n     primary school  teachers  on  their<br \/>\n     respective establishments\tinto the<br \/>\n     posts of  Head Masters in the scale<br \/>\n     of pay  Rs. 145-5-175-6-187-E.B.-6-<br \/>\n     205-9-250, sanctioned in Government<br \/>\n     Resolution,   Education and  social<br \/>\n     Welfare Department,  No.PTP. 1069-F<br \/>\n     dated the\t 19th June,  1969,  with<br \/>\n     retrospective   effect   from   1st<br \/>\n     April, 1966, the number of posts to<br \/>\n     be upgraded by each Zilla Parishad.<br \/>\n     authorized\t  Municipality.\t  Nagpur<br \/>\n     Municipal\t  Corporation\t or    a<br \/>\n     Municipal Council,\t as the case may<br \/>\n     be, should\t be equal  to the  total<br \/>\n     of:\n<\/p><\/blockquote>\n<blockquote><p>     (i) the  number of\t primary schools<br \/>\n     teaching  upto   and  inclusive  of<br \/>\n     Standard VII; and\n<\/p><\/blockquote>\n<blockquote><p>     (ii)  the\t other\tprimary\t schools<br \/>\n     having 200\t or more pupils on their<br \/>\n     rolls on 1st April 1966.<br \/>\n\t  The\tZilla\tParishads,   the<br \/>\n     authorized\t  Municipalities,    the<br \/>\n     Nagpur  Municipal\tCorporation  and<br \/>\n     Municipal\t Councils    in\t  Nagpur<br \/>\n     Division should be requested to fix<br \/>\n     the number\t of\t posts\tof  Head<br \/>\n     Masters  on   the\tbasis  indicated<br \/>\n     above on  1st   April 1966\t for the<br \/>\n     first  time   and\tto  subsequently<br \/>\n     review it annually on 1st April.\n<\/p><\/blockquote>\n<blockquote><p>      2. (A) The Zilla\tParishads should<br \/>\n     be requested  to fill  up the posts<br \/>\n     of Head  Masters  by  promotion  in<br \/>\n     accordance with   the provisions of<br \/>\n     Rule 6(4)\tread with  item No.8  in<br \/>\n     Appendix IV  (Part lI) to Rule 5 of<br \/>\n     the  Maharashtra\tZilla  Parishads<br \/>\n     District\tServices   (Recruitment)<br \/>\n     Rules, 1967.\n<\/p><\/blockquote>\n<blockquote><p>\t  EXPLANATION.-\t   A\t primary<br \/>\n     teacher who  has put  in continuous<br \/>\n     service of\t five years as a teacher<br \/>\n     and who  is trained  should be held<br \/>\n     eligible  for   promotion\tto   the<br \/>\n     upgraded post  of Head Master. Five<br \/>\n     years&#8217;service\t need\t     not<br \/>\n     necessarily    be\t   post-training<br \/>\n     service.\n<\/p><\/blockquote>\n<blockquote><p>     (B) The  Municipal\t School\t Boards,<br \/>\n     the  Nagpur  Municipal  Corporation<br \/>\n     and  the\tmunicipal  Councils   in<br \/>\n     Nagpur Division should be requested<br \/>\n     to\t fill\tup  the\t posts\tor  Head<br \/>\n     Masters\t  authorized  under  the<br \/>\n     Government Resolution  by promotion<br \/>\n     in accordance  with the Recruitment<br \/>\n     Rule attached  to this   Government<br \/>\n     Resolution\t (Schedule   A)\t and  in<br \/>\n     consultation\twith  the  Staff<br \/>\n     Selection Committee, if any.\n<\/p><\/blockquote>\n<blockquote><p>     3. The  fixation of pay. payment of<br \/>\n     arrears and  other cognate\t matters<br \/>\n     should be\tregulated in  accordance<br \/>\n     with the  instructions contained in<br \/>\n     Schedule\tB   attached   to   this<br \/>\n     Government Resolution.\n<\/p><\/blockquote>\n<blockquote><p>     4.\t  This\t Government   Resolution<br \/>\n     issues with  the concurrence of the<br \/>\n     Rural  Development\t Department  and<br \/>\n     Finance  Department,  vide\t Finance<br \/>\n     Department, Unofficial\t     No.<br \/>\n     1750\/XXVI,\t dated\t 22nd\tOctober,<br \/>\n     1970.\n<\/p><\/blockquote>\n<blockquote><p>\t  By order  and in  the name  of<br \/>\n     the Governor of Maharashtra.&#8221;<br \/>\n\t  Schedule  A  attached\t to  the<br \/>\n     aforesaid Resolution  made it clear<br \/>\n     that appointment to the posts shall<br \/>\n     be made  by promotion  on the basis<br \/>\n     of seniority-cum-merit  from  among<br \/>\n     trained primary  school teachers in<br \/>\n     the service of the Municipal School<br \/>\n     Board, Corporation\t of Council,  as<br \/>\n     the case may be, who have completed<br \/>\n     not less than 5 years of continuous<br \/>\n     service as a teacher.\n<\/p><\/blockquote>\n<blockquote><p>\t  In Schedule B to the aforesaid<br \/>\n     Resolution the  &#8216;Head   Master&#8217; was<br \/>\n     defined thus &#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t  &#8220;A  &#8220;Head   Master&#8217;  means   a<br \/>\n     primary teacher  who was working as<br \/>\n     the  Head\tor  Head  Teacher  of  a<br \/>\n     primary school.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t     Expression\t &#8220;upgraded  Head<br \/>\n     Master&#8221; was defined thus :<br \/>\n\t  &#8220;A  post   of\t &#8216;upgraded  Head<br \/>\n     Master&#8217; means  the newly authorized<br \/>\n     post of Head Master in the grade of<br \/>\n     Rs.145-250&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>\t   Expression  &#8220;primary\t teacher<br \/>\n     eligible\tfor   appointment&#8221;   was<br \/>\n     defined thus:\n<\/p><\/blockquote>\n<blockquote><p>\t  &#8220;A primary  teacher&#8217;\teligible<br \/>\n     for appointment&#8217;  as an\tupgraded<br \/>\n     Head Master  is  that  teacher  who<br \/>\n     fulfills the  conditions laid  down<br \/>\n     in the  recruitment  rule\tfor  the<br \/>\n     said  post\t read  with  explanation<br \/>\n     given below  para 2(A) of the  main<br \/>\n     Government Resolution to which this<br \/>\n     Schedule is<br \/>\n     who on  the basis of his seniority-<br \/>\n     cum-merit, had  been found eligible<br \/>\n     by the  competent\tauthority  (i.e.<br \/>\n     the District  Selection Board,  the<br \/>\n     Staff Selection Committee etc.) for<br \/>\n     appointment to the said post.&#8221;<\/p><\/blockquote>\n<blockquote><p>\t  Expression\ta\t primary<br \/>\n     teacher\t&#8216;entitled\t      to<br \/>\n     appointment&#8221;   was defined ) thus:-<br \/>\n\t  A\t primary\t teacher<br \/>\n     &#8216;entitled\t to appointment&#8217;  as  an<br \/>\n     upgraded\t  Head\t Master\t  on   a<br \/>\n     particular date  is that\t teacher<br \/>\n     who       is      eligible\t     for<br \/>\n     appointment and  who, by  virtue of<br \/>\n     this rank\tin the\tlist of teachers<br \/>\n     eligible  for  appointment\t to  the<br \/>\n     posts  of\tupgraded  Head\tMasters,<br \/>\n     becomes due  for appointment to the<br \/>\n     said post on that date.&#8221;<br \/>\n\t  The  date\tof\tnotional<br \/>\n     appointment was defined thus:\n<\/p><\/blockquote>\n<pre>\t  \"Date\t    of\t\tnotional\n     appointment\"   is that   date    on\n<\/pre>\n<blockquote><p>     which   a\tprimary teacher entitled<br \/>\n     to appointment  as\t     an upgraded<br \/>\n     Head   Master   would   have   been<br \/>\n     appointed\t as such    because    a<br \/>\n     vacancy was available on that date,<br \/>\n     (It may be mentioned that in a vast<br \/>\n     majority of cases, 1st April, 1966,<br \/>\n     1st April,\t 1967, 1st  April  1968,<br \/>\n     1st April\t1969, 1st April 1970 and<br \/>\n     so on will be the notional dates of<br \/>\n     appointment.   In\t a   few   cases<br \/>\n     however,  the   notional  dates  of<br \/>\n     appointment  may  fall  within  the<br \/>\n     period  intervening   between   the<br \/>\n     aforesaid\tdates  if  vacancies  of<br \/>\n     upgraded Head  Masters  had  arisen<br \/>\n     owing to  retirement,   resignation<br \/>\n     removal, dismissal, death etc.) &#8220;<\/p><\/blockquote>\n<pre>\n\t  Schedule  B\talso  classified\n     the different   types     of  cases\n     where appropriate\tauthority    was\n     entitled\t    to upgrade\tthe post\n<\/pre>\n<blockquote><p>     of teacher\t to that of  Head Master<br \/>\n     and   to\t review\t  the\tposition<br \/>\n     annually. The relevant portions  of<br \/>\n     the   Resolution\t   is  extracted<br \/>\n     hereinbelow in extenso:<\/p><\/blockquote>\n<blockquote><p>\t  II. CLASSIFICATION OF CASES<br \/>\n\t  The\t  Zilla\t      Parishads,<br \/>\n     Municipal School\t\t Boards,<br \/>\n     Municipal\t   Corporations\t     and<br \/>\n     Municipal\tCouncils   of\t  Nagpur<br \/>\n     Division\t have\t been authorized<br \/>\n     to\t      create\t posts\t      of<br \/>\n     upgraded Head  Masters with  effect<br \/>\n     from 1st  April 1966  and to review<br \/>\n     the position  annually  on\t 1st  of<br \/>\n     April every  year thereafter.  As a<br \/>\n     result, following\ttypes  of  cases<br \/>\n     are likely to arise:\n<\/p><\/blockquote>\n<blockquote><p>\t  (a)\tA     primary\t teacher<br \/>\n     who   is entitled\tto   appointment<br \/>\n     as\t   an  upgraded\t  Head\t  Master<br \/>\n     from      1st\t April 1966  and<br \/>\n     has     also      actually\t  worked<br \/>\n     continuously   as\ta   Head  Master<br \/>\n     of\t     an\t   eligible\t Primary<br \/>\n     School from 1st April 1966, or from<br \/>\n     any   subsequent\tdate,\tor   for<br \/>\n     intermittent  periods   after   1st<br \/>\n     April   1966,   till   his\t  actual<br \/>\n     appointment  as  an  upgraded  Head<br \/>\n     Master after  the newly  authorized<br \/>\n     post of\tupgradedad  Masters  are<br \/>\n     formally  created:\t  or  till   his<br \/>\n     superannuation.\t     retirement,<br \/>\n     resignation etc. on a date prior to<br \/>\n     the  date\t on  which   the   newly<br \/>\n     authorized posts  of upgraded  Head<br \/>\n     Masters are formally created.\n<\/p><\/blockquote>\n<blockquote><p>\t  (b)\tA     primary\t teacher<br \/>\n     who   is entitled\tto   appointment<br \/>\n     as\t   an  upgraded Head Master from<br \/>\n     1st April\t      1966 but\thas  not<br \/>\n     actually worked as a  Head\t  Master<br \/>\n     of\t   an\teligible  Primary School<br \/>\n     for any   period\tof    whatsoever<br \/>\n     from 1st  April 1966  till he    is<br \/>\n     actually\t  appointed\tas    an<br \/>\n     upgraded.\tHead  Master  after  the<br \/>\n     newly authorized  posts of upgraded<br \/>\n     Head Masters  are formally created;<br \/>\n     or\t  till\t  his\t superannuation,<br \/>\n     retirement, resignation  etc. on  a<br \/>\n     date prior to the date on which the<br \/>\n     newly authorized  posts of upgraded<br \/>\n     Head Masters are formally crated.\n<\/p><\/blockquote>\n<blockquote><p>\t  (c)\tA     primary\t teacher<br \/>\n     who   is entitled\tto   appointment<br \/>\n     as\t   an  upgraded Head   Master on<br \/>\n     any   date\t      subsequent to  1st<br \/>\n     April   1966   and who\t     has<br \/>\n     actually\t  worked continuously as<br \/>\n     a\tHead   Master  of   an\teligible<br \/>\n     primary   school\tfrom   1st April<br \/>\n     1966  or from  any subsequent date,<br \/>\n     or\t  for intermittent  periods from<br \/>\n     1st    April   1966,    till    his<br \/>\n     actual appointment\t as an\tupgraded<br \/>\n     Head   Master   after   the   newly<br \/>\n     authorized posts  of upgraded  Head<br \/>\n     Masters are  formally  created;  or<br \/>\n     till      his\t superannuation,<br \/>\n     retirement, resignation  etc. on  a<br \/>\n     date prior to the date on which the<br \/>\n     newly authorized  posts of upgraded<br \/>\n     Head Masters are formally created.\n<\/p><\/blockquote>\n<blockquote><p>\t  (d)\tA     primary\t teacher<br \/>\n     who   is entitled\tto   appointment<br \/>\n     as\t   an  upgraded Head   Master on<br \/>\n     any   date\t      subsequent to  1st<br \/>\n     April   1966  but has not\tactually<br \/>\n     worked   as a  Head Master\t of   an<br \/>\n     eligible\t primary school for  any<br \/>\n     period   whatsoever from 1st  April<br \/>\n     1966   till   he\tis\tactually<br \/>\n     appointed\t as an\t  upgraded  Head<br \/>\n     Master    after\t  the\t   newly<br \/>\n     authorized posts  of upgraded  Head<br \/>\n     Masters are  formally  created;  or<br \/>\n     till      his\t superannuation,<br \/>\n     retirement, resignation  etc. on  a<br \/>\n     date prior to the date on which the<br \/>\n     newly  authorized\t posts\tupgraded<br \/>\n     Head Masters are formally created.\n<\/p><\/blockquote>\n<blockquote><p>\t  (e) A\t primary teacher who was<br \/>\n     only eligible   for     appointment<br \/>\n     as\t  an upgraded  Head   Master and<br \/>\n     who   has\t\tactually  worked<br \/>\n     continuously as   a Head Master  of<br \/>\n     an eligible primary school from 1st<br \/>\n     April 1966,  or from\t     any<br \/>\n     subsequent\t   date,     or\t     for<br \/>\n     intermittent  periods   after   1st<br \/>\n     April 1966, but who is not entitled<br \/>\n     to appointment  as an upgraded Head<br \/>\n     Master even  after\t all  the  newly<br \/>\n     authorized posts  of upgraded  Head<br \/>\n     Masters  uptodate\t(i.e.  unto  1st<br \/>\n     April 1970)  are formally\tcreated;<br \/>\n     or would  not have\t become entitled<br \/>\n     to appointment  as an upgraded Head<br \/>\n     Masters  till  his\t superannuation,<br \/>\n     retirement, resignation  etc. on  a<br \/>\n     date prior to the date on which all<br \/>\n     the  newly\t  authorized  posts   of<br \/>\n     upgraded  Head  Masters  upto  date<br \/>\n     (i.e.  upto  1st  April  1970)  are<br \/>\n     formally created.\n<\/p><\/blockquote>\n<blockquote><p>\t  (f) A\t primary teacher  who is<br \/>\n     not even  eligible for  appointment<br \/>\n     as an  upgraded Head    Master  but<br \/>\n     actually\t    worked  continuously<br \/>\n     as\t  a    Head  Master   of      an<br \/>\n     eligible\t primary school from 1st<br \/>\n     April 1966,  or from\t     any<br \/>\n     subsequent\t   date.     or\t     for<br \/>\n     intermittent  periods   after   1st<br \/>\n     April   1966    till   the\t   newly<br \/>\n     unauthorise  posts\t    of\tupgraded<br \/>\n     Head  Masters     are\tformally<br \/>\n     created   an appointment are  made,<br \/>\n     thereto   of      teachers entitled<br \/>\n     to\t  appointment, or    till    his<br \/>\n     superannuation,\t     retirement,<br \/>\n     resignation   etc. on   a\t    date<br \/>\n     prior to  the  date  on  which  the<br \/>\n     newly authorized  posts of upgraded<br \/>\n     Head Masters are formally created.&#8221;<\/p><\/blockquote>\n<p>     Respondents nos. 1 to 4 filed Writ Petition No. 1638 of<br \/>\n1489 before  the Bombay\t High Court  at Aurangabad  claiming<br \/>\nthat they  are entitled\t to the tine scale of pay admissible<br \/>\nto&#8217; the post of Head Master with effect from 1.4.1966 on the<br \/>\nbasis  of   the\t aforesaid   Government\t  Resolution   dated<br \/>\n22.10.1970. While  the matter  was pending  before the\tHigh<br \/>\nCourt the  Chief Executive Officer of Zilla Parishad who was<br \/>\nthe  competent\t authority  to\t decide\t the   question\t  of<br \/>\nupgradation and\t fixing of scale of pay of the upgraded Head<br \/>\nMasters considered  the representations filed by respondents<br \/>\n1 to  4\t and  by  his  order  dated  18.4.90  directed\tthat<br \/>\nrespondents 1  to 4  be granted\t the scale  of pay meant for<br \/>\nupgraded Head Masters with effect from 1.4.1966. Pursuant to<br \/>\nthe aforesaid  order of\t the  Chief  Executive\tOfficer\t the<br \/>\nEducation Officer of Zilla Parishad passed the consequential<br \/>\norder of  31.5.1990 fixing the scale of pay of respondents 1<br \/>\nto 4 in the upgraded scale. But when the matter was referred<br \/>\nto the Accounts Officers of Zilla Parishad for\tverification<br \/>\nit was\the who\tpointed out the error error committed by the<br \/>\nChief Executive Officer and indicated that the said order is<br \/>\ncontrary to  the Government  Resolution dated 22.10.1970. On<br \/>\nthe basis  of the  aforesaid notings of the Accounts Officer<br \/>\nthe Chief  Executive Officer  suspended the operation of his<br \/>\nearlier\t order\t dated\t18.4.1990  and\tthe  orders  of\t the<br \/>\nEducation  Officer   dated  31.5.1990  by  his\torder  dated<br \/>\n26.10.1990.  In\t the  pending  Writ  proceedings  the  Zilla<br \/>\nParishad and  other officers  filed their counter affidavits<br \/>\nindicating that\t the respondents  l to 4 could not have been<br \/>\ngranted the  higher scale  of pay  in the  grade of upgraded<br \/>\nHead Masters  as such  posts were not available, in terms of<br \/>\nClauses (i) and (ii) of the Resolution dated 22.10.1970. The<br \/>\nHigh Court,  however, by  the impugned\torder  without\teven<br \/>\nnoticing the order of the Executive Officer dated 26.10.1990<br \/>\nand solely  relying upon  his earlier  order dated 18.4.1990<br \/>\nallowed the Writ Application and hence this appeal.\n<\/p>\n<p>     Mr. Manoj\tSwarup learned\tcounsel\t appearing  for\t the<br \/>\nappellant contended  that the  High  Court  committed  gross<br \/>\nerror in giving effect to the order of the Executive Officer<br \/>\ndated 18.4.1990\t even though  the said\torder had  been kept<br \/>\nunder suspension  by the  later order  dated 26.10.1990. The<br \/>\nlearned counsel\t further urged\tthat  though  the  Executive<br \/>\nOfficer of Zilla Parishad is entitled to upgrade the post of<br \/>\nprimary school\tteachers on  their establishment to the post<br \/>\nof Head\t Master but such upgradation would be dependent upon<br \/>\nthe  number   of  vacancies  available\tafter  applying\t the<br \/>\npreconditions mentioned\t in the Resolution dated 22.10.1970.<br \/>\nSince the  Chief Executive  Officer  without  focussing\t his<br \/>\nattention to that had passed orders in favour of respondents<br \/>\n1 to  4 the  error having  been pointed\t out by the Accounts<br \/>\nOfficer he  reconsidered the matter and had placed the order<br \/>\nunder suspension  and the  High Court without even examining<br \/>\nthe question as to whether there was vacancy for upgradation<br \/>\nin terms  of Resolution\t dated 22nd  Octobers 1970 committed<br \/>\nerror in  directing implementation  of the  earlier order of<br \/>\nthe Executive Officer dated 18.4.99.\n<\/p>\n<p>     The learned  counsel for  the respondent  on the  other<br \/>\nhand  contended\t  that\t there\t were\tseveral\t  subsequent<br \/>\nclarificatory orders  issued by\t the State  Government which<br \/>\nwould make the position clear that respondents are  entitled<br \/>\nfor being  promoted to the upgraded post of Head Masters and<br \/>\nthe High  Court did  not commit any error in granting relief<br \/>\nin question. But on being questioned the learned counsel for<br \/>\nthe respondents\t could not  lay his  hand on  any  of  those<br \/>\ncirculars nor  was he able to establish that the respondents<br \/>\nwere entitled  to be  promoted to  the upgraded post of Head<br \/>\nMasters in  accordance with  the Resolution  of\t the  Stated<br \/>\nGovernment dated 22.10.1970.\n<\/p>\n<p>     Having heard  the learned\tcounsel for  the parties  we<br \/>\nfind sufficient force in the arguments advanced by Mr. Manoj<br \/>\nSwarup, learned\t counsel  for  the  appellants.\t On  a\tbare<br \/>\nreading of  the Resolution  dated 22.10.1970  we are  of the<br \/>\nopinion that  a Chief  Executive Officer of a Zilla Parishad<br \/>\nwould be  authorized to\t upgrade the  post of primary school<br \/>\nteacher to  that  of  Head  Master  provided  the  condition<br \/>\nprecedent prescribed  in the  said Resolution are satisfied.<br \/>\nThe Resolution\tin question does not ipso facto converts the<br \/>\npost of\t primary school\t teacher to  that of Head Master. In<br \/>\nthis view  of the  matter the  Chief Executive\tOfficer\t was<br \/>\nentitled to  consider the  matter afresh and put the earlier<br \/>\norder in  abeyance. Non\t consideration of  his\torder  dated<br \/>\n26.10.1990 by the High Court and directing implementation of<br \/>\nthe earlier  order dated  18.4.1990 vitiates the judgment of<br \/>\nthe High Court. In the aforesaid premises the impugned order<br \/>\nof the\tHigh Court  cannot be  sustained and  we accordingly<br \/>\nquash the  same. Needless  to mention  that since  the Chief<br \/>\nExecutive Officer  has merely  suspended the  earlier  order<br \/>\ndated 18.4.1990\t and has  not taken  any final decision with<br \/>\nregard to   the\t entitlement   of  respondents\t1  to  4  to<br \/>\nbe appointed against the upgraded post of Head Master and if<br \/>\nso with\t effect\t  of what  date, the  said  Chief  Executive<br \/>\nOfficer, appellant  in the  present appeal,  is directed  to<br \/>\ntake a\tfinal decision\twithin\tthree months  from the\tdate<br \/>\nof   receipt of\t this order  and  communicate  the  same  to<br \/>\nrespondents 1 to 4.\n<\/p>\n<p>     This  appeal   is\taccordingly   allowed.\tBut  in\t the<br \/>\ncircumstances there will be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Chief Executive Officer,Zilla &#8230; vs Syed Yasin &amp; Ors on 24 April, 1996 Equivalent citations: 1996 AIR 1994, JT 1996 (5) 135 Author: G Pattanaik Bench: G.B.
