RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n                A.R.No.38 of 2008\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n       Dated this the 29th day of July, 2009.\n\n                    O R D E R\n<\/pre>\n<p>1.The parties to this arbitration request have a<\/p>\n<p> contract   between   them    which   contains   an<\/p>\n<p> arbitration   clause.  The   said   Memorandum  of<\/p>\n<p> Understanding provides for reference of disputes<\/p>\n<p> to a sole arbitrator. The petitioner contends<\/p>\n<p> that in spite of notice, the respondent has not<\/p>\n<p> agreed   to  further  action   in  terms   of  the<\/p>\n<p> arbitration clause and hence, this request for<\/p>\n<p> appropriate measures.\n<\/p>\n<\/p>\n<p>2.The plea put forward by the respondent is that in<\/p>\n<p> the absence of any claim against the respondent<\/p>\n<p> upon   the  termination   of  the   Memorandum  of<\/p>\n<p> Understanding  as   stipulated   in  clause  10(b)<\/p>\n<p> thereof,  there   can  be   no  arbitration.  This<\/p>\n<p><span class=\"hidden_text\">AR38\/2008             -: 2 :-<\/span><\/p>\n<p> contention would not stand because the termination<\/p>\n<p> of an agreement between the parties would not, by<\/p>\n<p> itself,   determine   the    continuance  of   the<\/p>\n<p> arbitration agreement and a clause providing for<\/p>\n<p> arbitration would survive the termination of a<\/p>\n<p> contract since the disputes between the parties<\/p>\n<p> which arise out of the termination itself would be<\/p>\n<p> a matter for arbitration. This principle being<\/p>\n<p> well settled, including by the decision of the<\/p>\n<p> Apex Court in SBP &amp; Co. v. Patel Engineering<\/p>\n<p> Ltd., 2005(8) SCC 618, I do not find any ground<\/p>\n<p> to refuse the request of the petitioner.       The<\/p>\n<p> provision for arbitration is that the arbitration<\/p>\n<p> shall be at Thiruvananthapuram.<\/p>\n<p>3.Having regard to the nature of the transaction<\/p>\n<p> which predominantly is a dispute relatable to the<\/p>\n<p> property law and law of contracts and taking into<\/p>\n<p> consideration all relevant aspects for the purpose<\/p>\n<p> of appointment of an arbitrator, Sri.M.S.Mohana<\/p>\n<p> Chandran,  District  Judge    (Retired), Karthika,<\/p>\n<p> Ammankovil Street, Thevally, Kollam &#8211; 691 009 is<\/p>\n<p><span class=\"hidden_text\">AR38\/2008             -: 3 :-<\/span><\/p>\n<p> appointed  as  arbitrator.
