ARIJIT PASAYAT, J.\n<\/p>\n<p>1.    Leave granted.\n<\/p>\n<\/p>\n<p>2.    Challenge in this appeal is to the judgment of a learned Single Judge<\/p>\n<p>of the Rajasthan High Court, Jaipur Bench. By the impugned judgment the<\/p>\n<p>High Court while upholding the conviction for offences punishable under<\/p>\n<p>Sections 7 and 16 of the Prevention of Food Adulteration Act, 1954 (in short<\/p>\n<p>the `Act&#8217;) imposed fine of Rs.6,000\/- and directed that the same is in<\/p>\n<p>commutation of the sentence of six months RI as awarded by learned Chief<\/p>\n<p>Judicial Magistrate, Sikar. It was further directed that the appropriate<br \/>\nGovernment shall formalize the matter by passing of an appropriate order<\/p>\n<p>under Clause (d) of Section 433 of the Code of Criminal Procedure, 1973<\/p>\n<p>(in short the `Code&#8217;) if the amount is deposited within a particular period.<\/p>\n<p>For the aforesaid purpose the High Court relied on a decision of this Court in<\/p>\n<p><a href=\"\/doc\/1188637\/\">Sukumaran Nair v. Food Inspector, Mavelikara<\/a> (1997 ((9) SCC 101).<\/p>\n<p>3.    Learned counsel for the appellant-State submitted that the High<\/p>\n<p>Court&#8217;s order is clearly unsustainable.\n<\/p>\n<\/p>\n<p>4.    Learned counsel for the respondent on the other hand supported the<\/p>\n<p>judgment.\n<\/p>\n<\/p>\n<p>5.    <a href=\"\/doc\/1980380\/\">In Dayal Singh v. State of Rajasthan<\/a> (2004 (5) SCC 721) it was inter-<\/p>\n<p>alia observed as follows:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;15. In the instant case it was not disputed that for the<br \/>\n             offence charged a minimum sentence of 6 months&#8217;<br \/>\n             rigorous imprisonment is prescribed by law. The<br \/>\n             appellant has been sentenced to undergo 6 months&#8217;<br \/>\n             rigorous imprisonment which is the minimum sentence.<\/p><\/blockquote>\n<p>             We are not inclined to modify the sentence by passing an<br \/>\n             order of the nature passed in N. Sukumaran Nair where<br \/>\n             this Court in exercise of its extraordinary jurisdiction<br \/>\n             imposed only a sentence of fine and directed the State to<br \/>\n             exercise its powers under Section 433 of the Code of<br \/>\n             Criminal Procedure to commute the sentence of simple<br \/>\n             imprisonment for fine. In the instant case, the appellant<br \/>\n             has been sentenced to undergo 6 months rigorous<br \/>\n             imprisonment. Moreover, we are firmly of the view that<br \/>\n             strict adherence to the Prevention of Food Adulteration<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><br \/>\n            Act and the Rules framed thereunder is essential for<br \/>\n            safeguarding the interest of consumers of articles of<br \/>\n            food. Stringent laws will have no meaning if offenders<br \/>\n            could get away with mere fine. We, therefore, find no<br \/>\n            reason to interfere with the sentence imposed against the<br \/>\n            appellant.&#8221;\n<\/p>\n<\/p>\n<p>6.    In the circumstances, the appeal is allowed. The sentence as imposed<\/p>\n<p>by the trial Court is restored. However, since the occurrence took place<\/p>\n<p>nearly three decades back if the accused-respondent moves the appropriate<\/p>\n<p>Government to commute the sentence of imprisonment, the same shall be<\/p>\n<p>considered in the proper perspective. For a period of three months the<\/p>\n<p>accused need not surrender to undergo sentence during which period it shall<\/p>\n<p>be open to him to move the appropriate Government for commutation. If no<\/p>\n<p>order in the matter of commutation is passed by the appropriate Government<\/p>\n<p>the accused shall surrender to custody to serve the remainder of sentence.<\/p>\n<p>7.
