Patel for the applicant and Mr RC<br \/>\nKodekar, learned Additional Public Prosecutor for the respondent &#8211;<br \/>\nState.\n<\/p>\n<p>\tIt<br \/>\nis brought to my notice that the father of the accused-applicant,<br \/>\nnamely, Bhimbhai Kachhar passed away on 11th April 2011.<br \/>\nIt is also submitted that at the relevant point of time he applied<br \/>\nfor temporary bail and was granted temporary bail by the trial Court<br \/>\nfor a period of two days with police escort.  However, at the<br \/>\nrelevant point of time, the accused-applicant did not deem fit to<br \/>\navail of  the advantage of the said order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, considering the fact that<br \/>\nthe father of the applicant has expired on 11th April 2011<br \/>\nand also considering the fact that he is an accused of offence of<br \/>\nmurder and he is in jail nearly for the past six months, it would be<br \/>\nfit and proper to order his release on temporary bail for a period of<br \/>\nthree days from the date of his release with police escort at the<br \/>\ncost of the accused-applicant.\n<\/p>\n<p>\tIn<br \/>\nthe aforesaid facts and circumstance, the applicant is ordered to be<br \/>\nreleased on  temporary bail for a period of three days from the date<br \/>\nof his release with police escort at the cost of the<br \/>\naccused-applicant on his executing a personal bond of Rs.15,000\/-.<br \/>\nHe shall surrender before the jail authorities on expiry of the<br \/>\nperiod of temporary bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
