Mehta, learned counsel for the appellant. I<br \/>\n\thave also considered the resistance placed by Ms. Samta Patel,<br \/>\n\tlearned counsel appearing for Nanavati Associates for the<br \/>\n\trespondent.\n<\/p>\n<p>I<br \/>\n\thave considered both the judgments, that is,  one of the trial court<br \/>\n\tdated 30th November, 1987 passed by learned Joint Civil<br \/>\n\tJudge [Junior Division] Porbandar in  Regular Civil Suit No. 174 of<br \/>\n\t1985 and another judgment  dated 8th January, 1990,<br \/>\n\tpassed by the learned Assistant Judge, District-Junagadh  at<br \/>\n\tPorbandar in Regular Civil Appeal No. 12 of 1988. The suit was filed<br \/>\n\tfor recovery of total sum with interest on account of loss sustained<br \/>\n\tby the plaintiffs and on appreciation of evidence and facts placed<br \/>\n\tby the parties, the  learned trial judge decreed the suit. The first<br \/>\n\tappellate court appreciated the evidence and the contents that were<br \/>\n\tplaced by the learned counsel appearing for the appellant and the<br \/>\n\trespondent,  and while hearing the First Appeal, dismissed the same.<br \/>\n\tThus, this is the case of two concurrent findings. Ultimately, the<br \/>\n\tcase placed by the plaintiff was based on facts and findings<br \/>\n\trecorded by both the courts below are on facts. As such, no<br \/>\n\tsubstantial question of law can be said to have involved in the<br \/>\n\tmatter. True it is that while admitting the appeal, this Court has<br \/>\n\tframed question of law as involved in the appeal, more particularly,<br \/>\n\tin the background of grounds mentioned in the memo of the appeal.\n<\/p>\n<p>On<br \/>\n\tplain reading of both the judgments of the two courts below, this<br \/>\n\tCourt is of the view that there is no merit in the appeal and the<br \/>\n\tquestion of law framed by this Court also revolves around the facts<br \/>\n\tthat were appreciated by both the courts below. There is no  element<br \/>\n\tof error in even appreciating the evidence. When loss of goods<br \/>\n\tresulting into financial loss to the plaintiff was found proved, the<br \/>\n\tdefendant-railway administration is supposed to make that loss good.<br \/>\n\tFor short, there is no merit in the appeal and therefore, the appeal<br \/>\n\tis dismissed.\n<\/p>\n<p>According<br \/>\n\tto Mr. Mehta, total decretal amount has been deposited by the<br \/>\n\trailway administration in the trial court. Therefore, now the<br \/>\n\tplaintiff can recover the decretal amount lying in the trial court.<br \/>\n\tIt will be open for the plaintiff to see that the amount deposited<br \/>\n\tby the railway administration is  in accordance with  the decree<br \/>\n\tpassed.
