Singh, Judge\nDate: 31.08.2010 \n:J U D G M E N T :\n<\/pre>\n<p>Petitioner has moved this Motion seeking initiation of<br \/>\nproceedings in Contempt against the respondents for<br \/>\ndisobedience of the interim directions issued on 28.02.2007<br \/>\nwhereby until the filing of Objections by the respondents, they<br \/>\nwere directed to issue Tender\/Quotations to the petitioner as<br \/>\nper the norms\/rules.\n<\/p>\n<p>The petitioners Complaint is that the respondents have<br \/>\nviolated the directions of the Court by issuing it only two<br \/>\nTender documents whereas the respondents had invited 500<br \/>\nQuotations and 80 Tender documents.\n<\/p>\n<p>The respondents Response to the Complaint indicates<br \/>\nthat total 67 number of Tenders and 1061 Quotations had<br \/>\nbeen asked for the period commencing from May 2007 to<br \/>\nDecember 2007 and, the petitioner was afforded opportunity<br \/>\nto compete for 6 Tenders with 100 Quotations against which it<br \/>\nhad responded only to 2 Tenders although its entitlement<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nunder rules was 4.7 Tenders and they had thus not disobeyed<br \/>\nthe directions of the Court in any manner whatsoever.<br \/>\nI have considered the submissions of the learned<br \/>\ncounsel for the parties in the light of the material placed on<br \/>\nrecords.\n<\/p>\n<p>It is true that the respondents had initially taken a wrong<br \/>\nstand to have issued 6 Tenders to the petitioner by registered<br \/>\npost. Their subsequent clarifications, however, indicate that<br \/>\nthe Tenders had been issued only under Certificate of Posting<br \/>\nwhich course was adopted by the respondents in case of all<br \/>\nother Approved Contractors as well.\n<\/p>\n<p>The respondents have produced the records indicating<br \/>\ndispatch of documents to the petitioner after having obtained<br \/>\nrequisite Certificates regarding posting of the documents.<br \/>\nIn view of the material placed on the records, I do not<br \/>\nfind any evidence to sustain the petitioners Complaint that<br \/>\nthe respondents had avoided despatch of documents to it in<br \/>\nterms of the interim directions of the Court.<br \/>\nThus, finding no merit in the Petition, it is dismissed.<br \/>\n(J.P.Singh)<br \/>\nJudge<br \/>\nJAMMU:\n<\/p>\n<p>31.08.2010<br \/>\nPawan Chopra  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jammu High Court M\/S Jay Kay Electronics Pvt.
