P.\n<\/p>\n<p>                                            &#8212;-\n<\/p>\n<p>3\/   30-06-2010            Heard the parties.\n<\/p>\n<p>                           The petitioners apprehend their arrest in a case<\/p>\n<p>                  instituted for offences under section 341, 323, 307, 504\/<\/p>\n<p>                  34 of the Indian Penal Code as also under section 3(1) (iv)<\/p>\n<p>                  of SC\/ST ( P.O.A.) Act. According to the prosecution case<\/p>\n<p>                  the accused persons are alleged to have cultivated certain<\/p>\n<p>                  lands, which were allotted to the informant by issuing<\/p>\n<p>                  certain red-cards under the provision of Bihar Land<\/p>\n<p>                  Reforms ( Fixation of Ceiling Area and Acquisition of<\/p>\n<p>                  Surplus Land ) Act, 1961.\n<\/p>\n<p>                           It is submitted by learned counsel for the<\/p>\n<p>                  petitioners that as a matter of fact prior to lodging of the<\/p>\n<p>                  present F.I.R. vide Annexure-1, one Nawal Kishore Singh,<\/p>\n<p>                  who happens to be the family member of the petitioners,<\/p>\n<p>                  had moved before this Court in C.W.J.C. No. 6090 of 2009.<\/p>\n<p>                  By order dated 14.05.2009 while disposing of the aforesaid<\/p>\n<p>                  writ petition it was directed that the land holders shall not<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>be dispossessed from the land in question till disposal of<\/p>\n<p>the Revision Case No. 7 of 2008. In that view of the matter<\/p>\n<p>it is claimed that petitioners were having their possession<\/p>\n<p>over the land in question and allegation of dispossession of<\/p>\n<p>the informant from the land in question is absolutely false<\/p>\n<p>and wrong. It is also submitted that in view of dispute of<\/p>\n<p>bonafide possession of the land in question the provisions<\/p>\n<p>under section 3 (1) (iv) of the SC\/ST ( P.O.A. ) Act are not<\/p>\n<p>applicable in the present case and, therefore, the present<\/p>\n<p>petition under section 438 Cr. P.C. is maintainable.<\/p>\n<p>         It is also submitted that even according to the<\/p>\n<p>prosecution case offence under section 307 of the Indian<\/p>\n<p>Penal Code is not attracted against the petitioners.<\/p>\n<p>         In the aforesaid facts and circumstances of the<\/p>\n<p>case, in the event of arrest or surrender in the court below<\/p>\n<p>within a period of four weeks from today, let the above<\/p>\n<p>named petitioners be enlarged on bail on furnishing bail<\/p>\n<p>bonds of Rs. 10,000\/- each with two sureties of the like<\/p>\n<p>amount each to the satisfaction of             Chief Judicial<\/p>\n<p>Magistrate   at   Purnia    in   connection   with   Rupouli   (<\/p>\n<p>Akbarpur) P.S. Case No. 73 of 2009, subject to conditions<\/p>\n<p>laid down under section 438 (2) Cr.P.C. and subject to<\/p>\n<p>further conditions that :\n<\/p>\n<p> (A)              one of the bailors must be government<\/p>\n<p>                  servant or close family members of the<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>                petitioners who will file an affidavit in the<\/p>\n<p>                court below showing his\/her relationship<\/p>\n<p>                with the petitioners,<\/p>\n<p>          (B)   if the petitioners are found involved in<\/p>\n<p>                same and similar nature of cases in<\/p>\n<p>                future, then in that case the informant\/<\/p>\n<p>                prosecution shall be at liberty to file a<\/p>\n<p>                petition for cancellation of the bail of the<\/p>\n<p>                petitioners, and if such a petition is filed,<\/p>\n<p>                the court below would be obliged to<\/p>\n<p>                dispose of the same in accordance with<\/p>\n<p>                law after giving opportunity of hearing to<\/p>\n<p>                all concerned.\n<\/p>\n<\/p>\n<pre>BTiwary               ( Birendra Prasad Verma, J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nilesh Yadav &amp;Amp; Ors vs State Of Bihar on 30 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
