{"id":102809,"date":"2008-07-18T00:00:00","date_gmt":"2008-07-17T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/natvargiri-vs-saurashtra-on-18-july-2008"},"modified":"2017-08-18T02:45:58","modified_gmt":"2017-08-17T21:15:58","slug":"natvargiri-vs-saurashtra-on-18-july-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/natvargiri-vs-saurashtra-on-18-july-2008","title":{"rendered":"Natvargiri vs Saurashtra on 18 July, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Natvargiri vs Saurashtra on 18 July, 2008<\/div>\n<div class=\"doc_bench\">Bench: K.M.Thaker<\/div>\n<pre>  \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n \n \n\n\n\t \n\nCA\/6930\/2008\t 5\/ 5\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nCIVIL\nAPPLICATION  No. 6930 of 2008\n \n\nIn\n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 9418 of 2003\n \n\n \n\n\n \n\n=========================================\n\n\n \n\nNATVARGIRI\nM MEGHNATHI - Petitioner(s)\n \n\nVersus\n \n\nSAURASHTRA\nCHEMICALS LIMITED - Respondent(s)\n \n\n=========================================\n \nAppearance : \nMR\nHASIT H JOSHI for Petitioner(s) : 1, \nMR NIRAV\nA JOSHI FOR NANAVATI ASSOCIATES for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\n\t\t\t\t\tDate\n: 18\/07\/2008 \n\n \n\n \n \n\n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication has been preferred by the applicant with below mentioned<br \/>\nprayers :\n<\/p>\n<p>(A)\tYour<br \/>\nLordships be pleased to direct the petitioner to give all the<br \/>\nretirement benefits like basic salary, bonus, full salary of 19<br \/>\nmonths from 1.1.03 to 31.7.04 and difference of full salary and last<br \/>\ndrawn salary from 31.7.2004 till the date of retirement of the<br \/>\napplicant, to the applicant workman by giving continuity of service<br \/>\nas if the has not been dismissed\/removed by the management from<br \/>\nservice and at par with other similarly situated employees as<br \/>\nreferred to above in the interest of justice.\n<\/p>\n<p>(B)\tCall<br \/>\nfor papers of both the petitioner arising from impugned award namely<br \/>\nSCA No.9418 of 2003, filed by Management as well as SCA No.16171 of<br \/>\n2003 and take up the said main matters for final disposal.\n<\/p>\n<p>(C)\tGrant<br \/>\nsuch other and further reliefs deemed just and proper in the facts<br \/>\nand circumstances of the case.\n<\/p>\n<p>2.\tSo<br \/>\nas to appreciate the relief prayed for by the applicant, it is<br \/>\nnecessary to take into account the statement of factual background.\n<\/p>\n<p>3.\tFrom<br \/>\nperusal of the record of Special Civil Application No.9418 of 2003<br \/>\nand Special Civil Application No.1617 of 2003 it appears that the<br \/>\nsaid petitions are cross-petitions and very same award is challegned<br \/>\nby the parties of this application. It also appears that the<br \/>\napplicant herein was terminated by the Company. Aggrieved by the said<br \/>\ntermination, the applicant herein had raised an industrial dispute,<br \/>\nwherein the learned Labour Court passed an award on 1.1.2003<br \/>\ndirecting the Company to reinstate the respondent without backwages.<br \/>\nAs aforesaid, the said award has been challenged by applicant &#8211;<br \/>\nworkman as well as opponent &#8211; Company and the aforesaid two petitions<br \/>\nare preferred, which are admitted and pending for hearing.\n<\/p>\n<p>4.\t\tDuring<br \/>\nthe pendency of the said petition, the Company had agreed to<br \/>\nreinstate the applicant without prejudice to its rights and<br \/>\ncontentions and accordingly with effect from 31.7.2004, the applicant<br \/>\nwas reinstated and from then onwards he continued in employment until<br \/>\nhe reached the age of superannuation on 11.12.2007 and consequently<br \/>\nhe was superannuated on 31.12.2007<\/p>\n<p>5.\tDuring<br \/>\nthe pendency of the said petition, the applicant has preferred<br \/>\npresent application with aforesaid relief. So far as first part of<br \/>\nrelief prayed for in para 6(A) is concerned, the applicant has prayed<br \/>\nfor the payment of salary for the period from 1.1.2003  to 31.7.2004<br \/>\n(i.e. the date on which he came to be reinstated as aforesaid).<br \/>\nAgainst the said prayer of the applicant, it is submitted on behalf<br \/>\nof the opponent that the Company has challenged the direction of<br \/>\nreinstatement and one of the grounds in support of the challenge is<br \/>\nthat the applicant had admitted legality and propriety of inquiry as<br \/>\nwell as finding of the Inquiry Officer and had challenged the<br \/>\ndecision of the management of terminating the applicant and that<br \/>\ntherefore,  it was not proper and justified for the learned Labour<br \/>\nCourt to quash the quantum of punishment and interfere with the<br \/>\ndecision of the penalty. It is further submitted that if the Company<br \/>\nsucceeds in his petition, then the direction for reinstatement would<br \/>\nbe set aside and the Company would not be under any obligation to<br \/>\nmake payment to the applicant with effect from 1.1.2003 to 31.7.2004.<br \/>\nThis Court is at this stage, inclined to accept the said submission<br \/>\nand it appears that the said relief does not deserve to be granted at<br \/>\nthis stage. Mr. Nirav Joshi, learned advocate for Nanavati Associates<br \/>\nfor Company further submitted that earlier also the applicant had<br \/>\nmade request for salary from the period 1.1.2003 to 31.7.2004,<br \/>\nhowever, this Court by an order dated 13.10.2004 had directed that<br \/>\nsuch a request can be considered at the time of final hearing of the<br \/>\npetition.  It is also submitted that it was without prejudice to the<br \/>\ncontentions that the Company had agreed to reinstate the applicant<br \/>\nand accordingly, he was reinstated with effect from 31.7.2004 and the<br \/>\nCompany has made the payment of regular salary to the applicant.<br \/>\nHowever, Mr. Joshi, learned advocate for the applicant disputed the<br \/>\nsaid submission and submitted that during the period of 31.7.2004 to<br \/>\n31.12.2007, the salary was not paid to the applicant as per his<br \/>\nentitlement. The said grievance of the applicant is beyond the scope<br \/>\nof the petition inasmuch as the subject matter of the petition is an<br \/>\naward dated 1.1.2003 passed by the learned Labour Court and that<br \/>\ntherefore, the events which might have taken place subsequent to the<br \/>\nabove referred award will be outside the scope of petition.<br \/>\nNotwithstanding the said aspect, Mr. Nirav Joshi, learned advocate<br \/>\nfor Nanavati Associates for the Company stated that if there has been<br \/>\nany short payment as compared to his entitlement, then company would<br \/>\nmake payment of the  differential amount to the applicant on or<br \/>\nbefore 31.7.2008. It is clarified that if the grievance of the<br \/>\napplicant still survives, then it would be open for him to take<br \/>\nappropriate steps in accordance with law in appropriate forum.\n<\/p>\n<p>6.\tIn<br \/>\nview of the earliar direction by the Court and in view of the<br \/>\naforesaid observations and clarification nothing further is required<br \/>\nto done, so far as this Civil Application is concerned.
