The younger daughter  was  repeatedly\nstruck with a gandasa and her neck was severed, as a  result\nof which she died instantaneously, while the other  daughter\nwas  struck on the neck and face with a banka and her  right\nhand was chopped off with the gandasa, and she died later in\nthe  hospital. P.W. 1 was struck on the face and upper\tpart\nof the body with the gandasa. She ran from the house through\nthe  village abadi and narrated the incident to P.W. 2\twho,\nin turn, informed P.W. 5, the Village Pradhan. After  visit-\ning  the scene of offence, P.W. 3 filed a First\t Information\nReport.\n    The\t appellants  were tried and the\t two  brothers\twere\nconvicted under Section 302 of the Indian Penal Code on\t two\ncounts\tof murder and were awarded capital punishment  while\nthe other three appellants were convicted under Section\t 302\nread with Section 149 of Indian Penal Code and sentenced  to\nlife  imprisonment. All the appellants were  also  convicted\nunder Section 148 of the Indian Penal Code.\n723\n    The\t High Court, affirming the conviction and  sentences\nawarded to the two brothers, observed that it was  satisfied\nthat  this was one of the 'rarest of the rare  cases'  where\ndeath penalty was the only appropriate sentence which  ought\nto be imposed on them.\nDismissing the appeal, this Court\n    HELD:  1.1 It is the duty of the Court to impose  proper\npunishment  depending  upon the degree\tof  criminality\t and\ndesirability to impose such punishment. [726B]\n    1.2 The punishment must fit the crime. The present cases\nwere cold-blooded brutal murders in which two innocent girls\nlost  their  lives.  The extreme brutality  with  which\t the\nappellants  acted shocks the judicial conscience.  The\tonly\npunishment which the appellants deserve for having committed\nthe reprehensible and gruesome murders of two innocent girls\nto wreak their personal vengeance over the dispute they\t had\nwith  regard  to property with their mother is\tnothing\t but\ndeath. [725H; 726B-C]\n    1.3 Failure to impose death sentence in such grave cases\nwhere  it  is a crime against the  society--particularly  in\ncases  of  murders committed with  extreme  brutality,\twill\nbring  to naught the sentence of death provided\t by  Section\n302 of the Indian Penal Code. [726A-B]\n    1.4 As a measure of social necessity and also as a means\nof deterring other potential offenders the sentence of death\non the two appellants is confirmed. [726C]\n    1.5\t The two appellants were guilty of a  heinous  crime\nout of greed and personal vengeance and deserve the  extreme\npenalty.  This\tcase falls within the test--'rarest  of\t the\nrare cases'--as laid down by this Court. [725G-H]\n    Bachan  Singh  v. Appellants Asharfi Lal and Babu who  are\treal<br \/>\nbrothers,  are under sentence of death on  their  conviction<br \/>\nunder s. 302 read with s. 149 of the Indian Penal Code, 1860<br \/>\nfor having committed the brutal murders of their two  nieces<br \/>\nKumari\tSumati, aged 14 years and Kumari Kalkanta,  aged  20<br \/>\nyears, daughters of their pre-deceased paternal cousin,\t and<br \/>\nunder  s. 307 read with s. 149 of the Indian Penal Code\t for<br \/>\nhaving attempted to commit the murder of Smt. Bulakan, widow<br \/>\nof Devi, and sentenced to undergo rigorous &#8216;imprisonment for<br \/>\n7  years. The remaining appellants Ganga Prasad and  Hemraj,<br \/>\ntwo  sons of Asharfi Lal, and Mata Badal, son of Babu,\thave<br \/>\nbeen  convicted under s. 302 read with s. 149 of the  Indian<br \/>\nPenal Code for having committed the two murders in  further-<br \/>\nance  of  the common object of their unlawful  assembly\t and<br \/>\neach of them sentenced to life imprisonment. They have\talso<br \/>\nbeen convicted under s. 148 for the attempted murder of Smt.<br \/>\nBulakan.  There was long drawn litigation between  the\tSmt.<br \/>\nBulakan\t on the one hand and the appellants on the other  in<br \/>\nrespect\t of certain agricultural property. The last  of\t the<br \/>\nseries of the litigation was a proceeding initiated under s.<br \/>\n145 of the Code of Criminal Procedure, 1973 on a report made<br \/>\nby  Smt.  Bulakan,  P.W. 1. To wreak  their  vengeance,\t the<br \/>\nappellants  effected  an entry on the night  between  August<br \/>\n13\/14, 1984 into the courtyard of the adjoining house  where<br \/>\nthe three ladies were sleeping on three different cots.\t The<br \/>\ntestimony  of  Smt. Bulakan, P.W. 1 shows that she  woke  up<br \/>\nhearing\t the shrieks of her younger daughter  Kumari  Sumati<br \/>\nand  found  that appellant Mata Badal was perched  over\t the<br \/>\nlower  part of the body of Kumari Sumati pressing  down\t her<br \/>\nlegs  while  appellant\tBabu repeatedly struck\ther  with  a<br \/>\ngandasa and severed her neck. The girl died almost instanta-<br \/>\nneously;  her head hung down the cot partially\tattached  to<br \/>\nthe neck. Smt. Bulakan further deposes that appellant Ashar-<br \/>\nfi Lal struck her other daughter Kumari Kalkanta on the neck<br \/>\nand face with a banka while appellant Hemra chopped off\t the<br \/>\nright hand of the girl with a gandasa. She also shrieked and<br \/>\nappellant Ganga Prasad struck her on the face and upper part<br \/>\nof  the body with a gandasa. She ran from her house  through<br \/>\nthe  village abadi and fell down near the house of  Kandhai,<br \/>\nP.W.  2, which was some 30-40 paces away. She  narrated\t the<br \/>\nincident  to Kandhai who immediately ran and informed  Bhag-<br \/>\nwati Prasad Pandey, P.W. 3 who resided some 200 paces  away.<br \/>\nThe Village Pradhan Bhagwati Prasad Pandey, P.W. 3  accompa-<br \/>\nnied  by some of the villagers arrived at the house of\tSmt.<br \/>\nBulakan and saw the<br \/>\n<span class=\"hidden_text\">725<\/span><br \/>\ndeceased  Kumari  Sumati lying dead on the  cot\t and  Kumari<br \/>\nKalkanta  lying\t unconscious in a pool of blood\t on  another<br \/>\ncot. She subsequently died in the hospital.<br \/>\n    Learned counsel for the appellants made no endeavour  to<br \/>\nchallenge  the conviction of the appellants for having\tcom-<br \/>\nmitted\tvarious offences with which they were  charged,\t and<br \/>\nrightly\t so. The conviction of the appellants rests  on\t the<br \/>\nunimpeachable and truthful evidence of Smt. Bulakan who\t was<br \/>\nherself the victim of the murderous assault, as\t conoborated<br \/>\nby P.W. 2 Kandhai and P.W. 3 Bhagwati Prasad Pandey. She  is<br \/>\na  natural witness and has given a vivid description of\t the<br \/>\nentire\tincident  resulting in the gruesome  deaths  of\t her<br \/>\ndaughters  Kumari Sumati and Kumari Kalkanta. It  is  estab-<br \/>\nlished in evidence that immediately after the occurrence she<br \/>\nnamed all the assailants. The first information report (Exh.<br \/>\nKa  1) lodged by Bhagwati Prasad Pandcy P.W. 3, the  Village<br \/>\nPradhan,  contains  the\t names of the  assailants.  The\t 1st<br \/>\nAdditional  Sessions  Judge, Barabanki by his  judgment\t and<br \/>\nsentence dated August 23, 1985 convicted the two  appellants<br \/>\nAsharfi\t Lal and Babu under s. 302 of the Indian Penal\tCode<br \/>\non two counts of murder and awarded them capital punishment.<br \/>\nHe  also  convicted  Ganga Prasad and Hemraj,  two  sons  of<br \/>\nAsharfi Lal, and Mata Badal, son of Babu, under s. 302\tread<br \/>\nwith  s.  149  and sentenced each of them  to  undergo\tlife<br \/>\nimprisonment.  All the appellants have also  been  convicted<br \/>\nunder s. 148 of the Indian Penal Code. The High Court by its<br \/>\njudgment dated August 11, 1986 on a careful consideration of<br \/>\nthe evidence has agreed with the learned Additional Sessions<br \/>\nJudge and confirmed the conviction and sentences awarded  to<br \/>\nthe  appellants. In affirming the sentence of death  imposed<br \/>\non  the two appellants Asharfi Lal and Babu, the High  Court<br \/>\nobserved  that\ton  a careful consideration  of\t the  entire<br \/>\nmaterial,  the\tfacts and circumstances and  the  applicable<br \/>\nlaw, it was satisfied that this was one of the rarest of the<br \/>\nrare  cases  where  death penalty is  the  only\t appropriate<br \/>\nsentence which ought to be imposed on them.\n<\/p>\n<p>    We have heard learned counsel for the appellants  mainly<br \/>\non  the question of sentence but we are not  impressed\twith<br \/>\nhis submission. The two appellants Asharfi Lal and Babu were<br \/>\nguilty\tof  a heinous crime out of greed and  personal\tven-<br \/>\ngeance\tand  deserve the extreme penalty.  This\t case  fails<br \/>\nwithin\tthe test &#8216;rarest of the rare cases&#8217; as laid down  by<br \/>\nthis  Court in Bachan Singh v. State of Punjab,\t [1980]\t SCC<br \/>\n648 as elaborated in the later case of <a href=\"\/doc\/545301\/\">Machhi Singh v. State<br \/>\nof  Punjab,<\/a>  [1983] 3 SCC 470. The punishment must  fit\t the<br \/>\ncrime.\tThese were cold-blooded brutal murders in which\t two<br \/>\ninnocent girls lost their<br \/>\n<span class=\"hidden_text\">726<\/span><br \/>\nlives. The extreme brutality with which the appellants acted<br \/>\nshocks\tthe judicial conscience. Failure to impose  a  death<br \/>\nsentence in such grave cases where it is a crime against the<br \/>\nsociety&#8212;particularly\tin cases of murders  committed\twith<br \/>\nextreme\t brutality&#8211;will  bring to naught  the\tsentence  of<br \/>\ndeath provided by s. 302 of the Indian Penal Code. It is the<br \/>\nduty  of the Court to impose a proper  punishment  depending<br \/>\nupon  the degree of criminality and desirability  to  impose<br \/>\nsuch  punishment. The only punishment which  the  appellants<br \/>\ndeserve for having committed the reprehensible and  gruesome<br \/>\nmurders\t of the two innocent girls to wreak  their  personal<br \/>\nvengeance over the dispute they had with regard to  property<br \/>\nwith  their mother Smt. Bulakan is nothing but death.
