DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition is preferred by the convict to condone the delay of two days<br \/>\ncaused in surrendering before the jail authority after the period of<br \/>\nfurlough was over and appeal came to be rejected on the ground that<br \/>\nit was not preferred within 60 days of time limit prescribed by the<br \/>\nCircular dated 4.2.2011 issued by the Additional Director General of<br \/>\nPolice and Inspector General of Police, Gujarat State, Ahmedabad.\n<\/p>\n<p>\tHeard<br \/>\nlearned APP for the respondent-State.\n<\/p>\n<p>\tConsidering<br \/>\nthe fact about ailment of the petitioner himself and due to heavy<br \/>\nrainfall for which he could not surrender before the jail authority<br \/>\nwithin the time and delay occurred of only two days and the appeal<br \/>\npreferred by the petitioner before the jail authority was rejected on<br \/>\nthe ground of delay, I deem it just and proper to direct the jail<br \/>\nauthority to consider the appeal on merits and pass a reasoned order<br \/>\nwithin a period of four weeks from today, since the period of 60 days<br \/>\nof preferring an appeal is prescribed by the Circular and there is no<br \/>\nstatutory bar.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid direction, the petition is allowed and the jail<br \/>\nauthority is directed to decide the appeal of the convict for<br \/>\ncondonation of delay of two days in surrendering before the jail<br \/>\nauthority within four weeks from today.\n<\/p>\n<p>[ANANT<br \/>\nS.
