The fact that the offences, if any, are alleged\nto  have  been\tcommitted more than six years  ago  and\t the\nappellant  was\tmerely a trader at the lowest  rung  of\t the\nhierarchy  in the Foreign Exchange Division of the Bank\t and\nnot a highly placed officer and the trial is bound to occupy\nthe  time of the' court of tint instance for not  less\tthan\ntwo or three years in view of the complicated nature of\t the\ncase and even then, it is extremely doubtful whether it will\nat all result in conviction no useful purpose will he served\nby allowing the prosecutions to continue. [H-174A]\n    However,  if the Bank has any legitimate  claim  against\nthe  appellant,\t it will he open to the Bank to\t pursue\t any\ncivil remedies which may be available to it. M. (M) Nos. 1105 &amp;\t1106<br \/>\nof 1985.\n<\/p>\n<p>M.R. Sharma and Dalveer Bhandari for the Appellant.<br \/>\nThe Judgment of the court was delivered by<br \/>\nMISRA, J. Special leave granted.\n<\/p>\n<p>     We have carefully considered the various aspects of the<br \/>\ncase and we are of the view that having regard to the nature<br \/>\nof  the dispute and the fact that the offences, if any,\t are<br \/>\nalleged\t to have been committed more than six years ago\t and<br \/>\nthe appellant was merely a trader at the<br \/>\n<span class=\"hidden_text\">174<\/span><br \/>\nlowest\trung of the hierarchy in the Foreign Exchange  Divi-<br \/>\nsion  of  the Bank and not a highly placed officer  and\t the<br \/>\ntrial  is  bound to occupy the time of the  court  of  first<br \/>\ninstance for not less that two or three years in view of the<br \/>\ncomplicated nature of the case and even then, it is extreme-<br \/>\nly doubtful whether it will at all result in conviction,  no<br \/>\nuseful\tpurpose will be served by allowing the\tprosecutions<br \/>\nto  continue.  Hence,  we allow the appeals  and  quash\t the<br \/>\ncharges\t against  the appellant.
