{"id":102988,"date":"2009-07-08T00:00:00","date_gmt":"2009-07-07T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/captain-rakesh-rihani-vs-state-of-punjab-on-8-july-2009"},"modified":"2016-06-30T02:14:40","modified_gmt":"2016-06-29T20:44:40","slug":"captain-rakesh-rihani-vs-state-of-punjab-on-8-july-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/captain-rakesh-rihani-vs-state-of-punjab-on-8-july-2009","title":{"rendered":"Captain Rakesh Rihani vs State Of Punjab on 8 July, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Captain Rakesh Rihani vs State Of Punjab on 8 July, 2009<\/div>\n<pre>In the High Court for the States of Pun jab and Haryana at Chandigarh.\n\n\n              CRM.M 16583 of 2009\n              Decided on July 08,2009.\n\n\n Captain Rakesh Rihani                        -- Petitioner\n\n                    vs.\n\nState of Punjab                              --Respondent.<\/pre>\n<p>Present:     Mr.Sameer Sachdeva, Advocate,for the petitioner<\/p>\n<p>             Mr.Ranbir Singh Rawat,A.A.G.Punjab.\n<\/p>\n<p>\nRakesh Kumar Jain, J:\n<\/p>\n<p>             Apprehending his arrest, the petitioner has filed this<\/p>\n<p>application for anticipatory bail in a case registered against him vide FIR<\/p>\n<p>No. 164 dated 06.4.2009 under Section 420 of I.P.C. at Police Station<\/p>\n<p>Kotwali, Patiala.\n<\/p>\n<p>              In short, the allegations against the petitioner are that though<\/p>\n<p>admittedly he is not an Advocate, yet he posed himself to be an Advocate<\/p>\n<p>and induced the complainant to engage him to conduct his case in the<\/p>\n<p>High Court and charged Rs.35,000\/-for that purpose.<\/p>\n<p>              Before coming to this Court, the petitioner had filed bail<\/p>\n<p>application No.96 of 2009 before the Addl. Sessions Judge, Patiala, which<\/p>\n<p>has been dismissed on 1.6.2009.\n<\/p>\n<p>              Learned counsel for the petitioner has submitted that the<\/p>\n<p>petitioner had appeared with Mr. Ranjan Lakhanpal Advocate of this Court,<\/p>\n<p>who had filed C.W.P No. 10624 on 16.7.2007 which has been dismissed as<\/p>\n<p>withdrawn on 26.7.2007. It is, thus, contended that no offence is made out<\/p>\n<p>against the petitioner.\n<\/p>\n<p>             On the other hand, learned State Counsel has argued that not<br \/>\n<span class=\"hidden_text\">               CRM.M 16583 of 2009                                        -2-<\/span><\/p>\n<p>only the petitioner, who is admittedly not an Advocate had posed himself<\/p>\n<p>as an Advocate and took the case of the complainant as well as fee, but also<\/p>\n<p>he had got his name printed on the Vakalatnama filed in the writ petition as<\/p>\n<p>an associate of Mr.Ranjan Lakhanpal Advocate and his name appears in<\/p>\n<p>C.W.P.No.11667 of 2007, as an Advocate, for the complainant therefore,<\/p>\n<p>the act of cheating is writ large on the part of the petitioner.<\/p>\n<p>              After hearing the learned counsel for the parties, I am of the<\/p>\n<p>view that the petitioner who is an imposter has induced and cheated<\/p>\n<p>innocent litigants like the petitioner who have no means to ascertain as to<\/p>\n<p>whether a person who is roaming around in Courts in the robes of an<\/p>\n<p>Advocate, is, in fact, an Advocate or not.          Since the      petitioner was<\/p>\n<p>introduced by his co-accused P.S.Kahlon as an Advocate of the High Court,<\/p>\n<p>the    complainant had believed him and had handed over his case and<\/p>\n<p>amount of Rs.35,000\/-. Thus, apparently, the petitioner is working as a tout<\/p>\n<p>in the District Courts     and is a great threat      to this pious and noble<\/p>\n<p>profession.\n<\/p>\n<p>              In view of the seriousness of the offence, I do not find any extra<\/p>\n<p>ordinary circumstance to grant the petitioner anticipatory bail.
