No.3781 of 2010, through which the appellant has<\/p>\n<p>                     prayed for condonation of delay in filing of this appeal.<\/p>\n<p>                               It has been submitted that the impugned order<\/p>\n<p>                     was passed without notice to the appellant and as soon as<\/p>\n<p>                     the appellant came to know of it, he preferred the writ<\/p>\n<p>                     petition which was subsequently permitted to be withdrawn<\/p>\n<p>                     with an observation that the appellant may prefer such an<\/p>\n<p>                     appeal.\n<\/p>\n<p>                               In the facts of the case, the delay in preferring this<\/p>\n<p>                     appeal is condoned.\n<\/p>\n<p>                               I.A. no.3781 of 2010 stands allowed.\n<\/p>\n<p>                               Let a copy of the memorandum of appeal be<\/p>\n<p>                     served upon learned counsel for the Income Tax Department<\/p>\n<p>                     within one week and put up for admission thereafter.<\/p>\n<pre>\n\n\n                                              ( R.
