In this writ petition, petitioners are challenging the<\/p>\n
renewal of lease dated 04.06.2007 executed in <\/p>\n
respondent No.4 by the second respondent.–\u00a5V_:l’Eang’alo’:fe’ <\/p>\n
Development Authority. Petitionerspgare  V’<\/p>\n
the preliminary and \ufb01nal notifications<\/p>\n
and 18.11.1967 and also the <\/p>\n
Act under Section 16, VA pg _ _ .. ..\n<\/p>\n
2. It is the case nfthe; ppetitioncrgs that husband of
\nthe first petitione_r, la’te’*B;V granted land
\nto an ac:re.Vlclon1pri’sed in Block No.1V of
\nSy.No.:’1_\u20ac314l_ ‘   Village,<\/p>\n
Yeshvvanthiapurarn  Bangalore North Taluk as per<\/p>\n
  ‘2-;”\u00a7–‘\u00ab1’=’ November 1960. Petitioners 2, 3<\/p>\n
 children of late I-3.V.Yellappa. Their<\/p>\n
 that without issuing notice to late Yellappa<\/p>\n
 and Witliout providing any opportunity to him, the<\/p>\n
 .’Ain1p_1;igned acquisition proceedings have been initiated<\/p>\n
c ating in the final notification dated 18.11. 1967 .<\/p>\n
4<\/span><\/p>\n
3. It is their further case that late Yellappa having<\/p>\n
come to know about the acquisition proceedings,-i’nade<\/p>\n
a representation allegediy on 22.01.1969 <\/p>\n
the Chairman, CITB, Bangalore informing   <\/p>\n
notice of the said acquisition %Js}*ats”‘ie~su.ed.;\u00abto”‘h_i1fn*~andi<\/p>\n
that he was the grantee of the to <\/p>\n
acre comprised in  He  his<\/p>\n
address for   this
\nrepresentation ‘did  ‘tti’afttdo-urable action,
\nanother   seeking
\ngrant of  the value of 1 acre
\nof land   Rs.Hao,ooo\/–. It is the further
\ncase ottthe “though the possession of the<\/p>\n
acquiregd land V_ ‘Was ‘ taken and a notification under<\/p>\n
  came to be issued, out of the total extent<\/p>\n
   guntas acquired as per the final<\/p>\n
notification published, only an extent of 20 acres 39<\/p>\n
it ., gutnas\ufb02twas shown as acquired and taken possession of.<\/p>\n
 therefore contended by the petitioners that the<\/p>\n
Wportion measuring 1 acre belonging to the petitioners<\/p>\n
was neither acquired nor taken possession of and it<\/p>\n
it<\/p>\n

enquiry and rejected the application. On appeal, the
\nDeputy Commissioner having set aside the order has<\/p>\n
ordered for resumption of the land and restoratio.n~.._of<\/p>\n

5. Sri Dinesh Kumar, learned counsel appearing
\nfor the Bangalore Development Authority, taking me<\/p>\n
through the statement of objections filed submits that<\/p>\n
kn<\/p>\n
as is clear from the final notification issued as back as
\non 18.11.1967, the entire extent of 30 acres 34 guntas
\ncomprised in Sy.No.16i has been acquired. This was<\/p>\n
followed by an award passed by the Land <\/p>\n
Officer on 18.11.1967. Copy of the awardis  ~<\/p>\n
along with the statement of objections llsecond if<\/p>\n
respondent as Annexure-R3.\n<\/p>\n
compensation is determinedv.,.4inrespect –of”‘v_:the:”lanld in”<\/p>\n
question and it is not,’open”‘forp:’the._petitioners at this
\ndistance of time to cliall’en_ge. acquisition<\/p>\n
proceedings, }.vh.ic’_l1 have 1: a t.tainled.j_fi.nality.<\/p>\n
 Sri ‘  learned counsel for the<\/p>\n
fourth  supported the acquisition<\/p>\n
  allotment made in favour of the<\/p>\n
1’cu_rth:”‘v4respontient by the Bangalore Development<\/p>\n

 .. ,  7′;*’HaVing heard the learned counsel for the parties<\/p>\n
   careful perusal of the entire materials, I find no<\/p>\n
it  ‘”legal substance in the challenge made to the acquisition<\/p>\n
proceedings. The acquisition proceedings were initiated<\/p>\n
\u00abW<\/p>\n
8<\/span><\/p>\n
as back as in the year 1964 by issuing a preliminary
\nnoti\ufb01cation dated 02.03.1964. This is followed by the<\/p>\n
\ufb01nal notification dated 18.11.1967. Even in <\/p>\n
noti\ufb01cation, entire extent of 30 acres   ‘<\/p>\n
mentioned. Thus, on issue of thefinal  <\/p>\n
total extent of land in sy.No.1\u00e91  been <\/p>\n
Award is also passed by the Acqt1_is1’tio”n  on it<\/p>\n
18.1 1. 1967.\n<\/p>\n
8. A perusal of   AnneXure–\n<\/p>\n
R3 along    it ilobjections by the
\nBangalore-vD’ev5e’1o’p:nent.VpAuthority’\u00a3makes it clear that in
\nrespecttof    of land, Valuation is made<\/p>\n
and the y’a.lue ,   said portion is arrived at<\/p>\n
 ‘\u00a5V.”‘As”regards the remaining extent of 9<\/p>\n
acres_35_’gi\u00a7in,ta-s, as the same was occupied by the<\/p>\n
inhabitan.tsli:’\u00a7–of: the viiiage known as Voddarapalya or<\/p>\n
3-e,_”Bovipaiya1- located in the same land therefore possession<\/p>\n
  p”‘doe.s not seem to have been taken of the said portion of<\/p>\n
   land which was occupied by the Villagers. However,<\/p>\n
“bias regards the land granted to the grantees including<\/p>\n
late B.V.Yellappa, there is specific mention in the award<\/p>\n
if<\/p>\n
9<\/span><\/p>\n
with regard to the determination of compensation<\/p>\n
payable to them. The name of B.V.Ye1lappa is shov-.r_i_1 at<\/p>\n
S1.No.6 in paragraph-10 in the award and <\/p>\n
to be entitled to compensation to an extent  1 V    <\/p>\n
is also observed that compensation”of_ <\/p>\n
Gopal Naidu, Srinivas, B.V.Ye11appa and <\/p>\n
w\/o B.V.Ye1lappa will be paid”i’to”them’after  the
\nup to date encumbrances  It is
\nthus clear thatthe  have been
\ncompleted  paward}  \u00e9passedlj\u00e9determining the
\n   of 1 acre of land
\nwhich .1 ellappa. Though the
\nnoti\ufb01cation  ;.Section 16(2) of the Land<\/p>\n
Aeqyg;is’ition  V. 10.12.1998, mentions that the<\/p>\n
 an extent 20 acres 39 guntas is taken<\/p>\n
 in any manner, help the petitioner<\/p>\n
-V to  1 acre of land belonging to him is neither<\/p>\n
 ig.,a(:quired nor taken possession of. Such an inference is<\/p>\n
–  iiiriperxnissible in the wake of the award passed and the<\/p>\n
1′ Wcloritents thereof. Therefore, it is not permissible for the<\/p>\n
petitioner to contend that entire extent of land was not<\/p>\n

acquired or taken possession of and that petitioners<\/p>\n
land falls outside the purview of acquisition.<\/p>\n
9. The Judgment relied upon by <\/p>\n

\nB.V.Yeilappa  been mentioned in the
\nprelipaiiiiaryll and the said Yellappa having
\n  heard in the matter, the entire<\/p>\n
lacl’qu_isitio’n.pijoceedings are vitiated, it is to be observed<\/p>\n
V -V that had the knowledge of acquisition as back<\/p>\n
 the year 1969 and admittedly, he had made<\/p>\n
—  repreisentation to the authorities bringing to their notice<\/p>\n
