DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicants for grant of<br \/>\n\tregular bail after the charge-sheet under Section 439 of Criminal<br \/>\n\tProcedure Code in connection with FIR being I-C.R.No. 3 of 2010<br \/>\n\tregistered with Amod Police Station for the offence punishable under<br \/>\n\tSections 457, 380 and 114 of Indian Penal Code.\n<\/p>\n<p>Mr.A.\n<\/p>\n<p>\tN. Malek, learned advocate, for the applicants referred to the FIR<br \/>\n\tand submitted that as now the charge-sheet is filed, present<br \/>\n\tapplication may be allowed considering the nature of offence. He<br \/>\n\tsubmits that the co-accused is released on bail.\n<\/p>\n<p>Mr.Kartik<br \/>\n\tPandya, learned APP resisted the application and submitted that<br \/>\n\tthere is a prima-facie case suggesting the involvement of the<br \/>\n\taccused and there are antecedents. Alternatively, it was submitted<br \/>\n\tthat some condition may be imposed.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate for the applicant and learned APP for the<br \/>\n\trespondent-State and having considered the submissions and also the<br \/>\n\tfact that charge-sheet has been filed and co-accused were released<br \/>\n\ton bail, present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No. 3 of 2010<br \/>\n\tregistered with Amod Police Station  on their executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand) each with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that they shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\ntheir presence before concerned Police Station on 1st<br \/>\nMonday of every month between 11.00 AM to 2.00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residences without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\n\ttheir passport, if any, to the lower \tCourt, within a week.\n<\/p>\n<p>\t(h)\tshall<br \/>\nnot enter the area of Amod Police Station \t\tfor 6 (six) months.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute.
