JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 10\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers :-\n<\/p>\n<p>&#8220;(A)\tYOUR<br \/>\nLORDSHIP be pleased to admit the special civil application<\/p>\n<p>(B)\tYOUR<br \/>\nLORDSHIP be pleased to issue appropriate writ order or direction<br \/>\nwhich the Hon&#8217;ble Court may deem fit and be pleased to passed an<br \/>\norder by directing the Respondent to grant promotion in favor of the<br \/>\npetitioner to the post of Executive Engineer by considering the facts<br \/>\nand circumstances of the case.\n<\/p>\n<p>(C)\tYOUR<br \/>\nLORDSHIP be pleased to issue appropriate writ order or direction<br \/>\nwhich the Hon&#8217;ble Court may deem fit and be pleased to directing to<br \/>\nthe Res. no 1 to complete the departmental inquiry prescribed under<br \/>\nthe resolution dtd. 20\/7\/1993 framed by the Res. No.2.\n<\/p>\n<p>(D)\tYOUR<br \/>\nLORDSHIP be pleased to issue appropriate writ order or direction<br \/>\nwhich the Hon&#8217;ble Court may deem fit and be pleased to directing to<br \/>\nthe Res. no 1 &amp; 2 to promote the petitioner to the post of<br \/>\nExecutive Engineer at least on Ad-hoc basis as per the G.R. dtd.<br \/>\n2\/4\/1983 &amp; 30\/10\/93.\n<\/p>\n<p>(E)\tPending,<br \/>\nadmission &amp; final hearing of this petition, directing to the Res.<br \/>\nno.1 to pronounce the punishment\/exonerate order in the pending<br \/>\ndepartmental inquiry till the final disposal of this petition.\n<\/p>\n<p>(F)\tSuch<br \/>\nother and further relief in the necessary and interest of justice be<br \/>\ngranted.&#8221;\n<\/p>\n<p>2.\tThe<br \/>\npetitioner is at present serving as Deputy Executive Engineer in<br \/>\nrespondent No.1 department. The grievance of the petitioner is that<br \/>\nas his name has been put in a sealed cover due to pendency of a<br \/>\ndepartmental inquiry, he is not being promoted as Executive Engineer,<br \/>\nthough a number of his juniors have been so promoted. It is averred<br \/>\nin the petition that the Departmental Promotion Committee met on<br \/>\n06.12.2008. On 24.12.2008, the name of the petitioner was mentioned<br \/>\nin the seniority list dated 05.11.2008, and he was required to be<br \/>\nconsidered for promotion along with his senior and junior colleagues,<br \/>\nbut his name was not mentioned in the promotion list on 30.10.2009<br \/>\ndue to the above-stated reason.\n<\/p>\n<p>3.\tMr.B.S.Brahmbhatt,<br \/>\nlearned advocate for the petitioner, has submitted that the<br \/>\ncharge-sheet has been served upon the petitioner on 06.03.2007,<br \/>\nwhereas the Departmental Promotion Committee met on 06.12.2008 i.e.<br \/>\nafter a period of almost 2 years. The petitioner is going to retire<br \/>\non 30.06.2011, that is, after about four months from today, and as<br \/>\nthe departmental inquiry is still pending, his right of consideration<br \/>\nfor promotion is seriously prejudiced, therefore, some directions may<br \/>\nbe given to the respondents to complete the inquiry in a time bound<br \/>\nmanner.\n<\/p>\n<p>4.\tMr.Maulik<br \/>\nG.Nanavati, learned Assistant Government Pleader, has submitted that<br \/>\nif some time bound directions are given for completion of the<br \/>\ninquiry, the respondents would complete the same expeditiously.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocate for the petitioner and the learned<br \/>\nAssistant Government Pleader, and as the petitioner is due to<br \/>\nsuperannuate on 30.06.2011, it would be in the interest of justice if<br \/>\nthe respondents are directed to complete the inquiry expeditiously.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above facts and circumstances, it is directed that<br \/>\nrespondent No.1 shall complete the departmental inquiry against the<br \/>\npetitioner within a period of six weeks from the date of receipt of a<br \/>\ncopy of this order. If the departmental inquiry is not completed by<br \/>\nthat date, the petitioner will be entitled for promotion, as has been<br \/>\naccorded to his juniors.\n<\/p>\n<p>7.\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>8.\tThe<br \/>\npetition is disposed of in the above terms.
