Whether the judgement should be reported in the Digest ?\n\nM.M.KUMAR, J.\n<\/pre>\n<p>             The instant petition is directed against order dated 29.8.2006<\/p>\n<p>(P.5) passed by the Divisional Commissioner, Patiala Division, Patiala<\/p>\n<p>dismissing the appeal filed under Section 146 of the Punjab Municipal<\/p>\n<p>Corporation Act, 1976 (for brevity &#8216;the Act&#8217;). In the appeal, the petitioner<\/p>\n<p>has challenged House Tax Bill No. 30817 dated 11.10.2004 in respect of<\/p>\n<p>property No. 3300 situated in Chhotti Baradari, Patiala for the year 2004-05.<\/p>\n<p>After considering the grounds of appeal filed by the petitioner and hearing<\/p>\n<p>counsel for the respondent the Commissioner found that repeated absence of<\/p>\n<p>the counsel for the petitioner was not bonafide as the petitioner was<\/p>\n<p>interested in continuing with the litigation in order to avoid the payment of<\/p>\n<p>the amount in dispute on one pretext or the other. It is pertinent to notice<br \/>\n<span class=\"hidden_text\"> CWP No. 11208 of 2009                  2<\/span><\/p>\n<p>that no appeal could be filed under Section 146 of the Act without<\/p>\n<p>depositing the amount of tax. The Commissioner further found that<\/p>\n<p>deduction has been given in the rate after hearing the assessee and the order<\/p>\n<p>was passed by the consent of the petitioner.\n<\/p>\n<p>             Mr. N.K.Suneja, learned counsel for the petitioner, has<\/p>\n<p>submitted that the property in question was purchased by the petitioner from<\/p>\n<p>the Improvement Trust. In that regard he has placed reliance on a document<\/p>\n<p>dated 3.11.1980 issued by the Patiala Improvement Trust, Patiala showing<\/p>\n<p>the rate at which the property was allotted in a development scheme,<\/p>\n<p>Chhotti Baradari. On that basis the argument raised is that as long as the<\/p>\n<p>property remains under the control of the Improvement Trust, the Municipal<\/p>\n<p>Council or Municipal Corporation cannot have any jurisdiction to assess the<\/p>\n<p>property for the purposes of house tax. He has also argued that no<\/p>\n<p>opportunity of hearing has been afforded to the petitioner and the order<\/p>\n<p>passed by the Divisional Commissioner is in flagrant violation of the<\/p>\n<p>principles of natural justice.\n<\/p>\n<p>             Having heard the learned counsel and perusing the paper book<\/p>\n<p>we are of the view that the instant petition does not merit admission and is<\/p>\n<p>liable to be dismissed. The petitioner has placed on record an order dated<\/p>\n<p>19.3.2004 whereby the property belonging to the petitioner was assessed for<\/p>\n<p>the purposes of house tax by the House Tax Sub Committee. The Sub<\/p>\n<p>Committee after hearing counsel for the petitioner has released the rate of<\/p>\n<p>house tax. It has been found that the total area as per the office report is 465<\/p>\n<p>Sq. yd. and covered area is 4275 sq. ft. The market value of the land has<\/p>\n<p>been assessed at Rs. 12,000\/- sq. yds and Rs. 325\/- sq. ft. The aforesaid<\/p>\n<p>estimation is based on the explanation tendered            by Area Inspector<br \/>\n<span class=\"hidden_text\"> CWP No. 11208 of 2009                 3<\/span><\/p>\n<p>regarding quality of construction. Accordingly total valuation of the unit<\/p>\n<p>was assessed and rental value at the rate of 5% of the cost was arrived at<\/p>\n<p>Rs. 3,41,522\/- p.a. On the basis of the aforesaid order of assessment bill<\/p>\n<p>dated 11.10.2004 was prepared and sent. The order of assessment has<\/p>\n<p>attained finality and there is no challenge to the aforesaid order. Only House<\/p>\n<p>Tax Bill dated 11.10.2004 has been challenged before the Commissioner<\/p>\n<p>which inevitably is based on the order of assessment dated 19.3.2004.<\/p>\n<p>Therefore, we find that the order of the Divisional Commissioner does not<\/p>\n<p>suffer from legal infirmity warranting interference of this Court.<\/p>\n<p>            The argument of the learned counsel that the Improvement<\/p>\n<p>Trust continues to control the property does not have any basis and remains<\/p>\n<p>unsubstantiated. The only reliance by the counsel for the petitioner was on<\/p>\n<p>the order dated 24.5.2006 which is an order passed by the Divisional<\/p>\n<p>Commissioner where the property was found to be under the Control of the<\/p>\n<p>Improvement Trust. But the property herein could not be shown, either<\/p>\n<p>before this Court or before the Commissioner, to be under the control of the<\/p>\n<p>Improvement Trust. In any case, we are not able to appreciate how the<\/p>\n<p>property allotted on 3.11.1980 could continue to be controlled by the<\/p>\n<p>Improvement Trust.\n<\/p>\n<p>            The other argument that principles of natural justice have been<\/p>\n<p>violated has also not impressed us because it is prepasetrous to say that<\/p>\n<p>opportunity of hearing was not given.
