(2) 421 JT 1990 (4)\t474\n 1990 SCALE  (2)942\n\n\nACT:\n    Karnataka  Civil  Services (General\t Recruitment)  Rules\n1977-Rule  6(3)(b)--Second  Division Clerks  in\t subordinate\ncourts--Benefit\t of age\t relaxation--Grant  of--Humanitarian\napproach--Necessity for.\n    Article  229 of the Constitution--Appointment  of  court\nstaff-Chief  Justice\/Administrative Judge--Not\tan  absolute\nruler--To  operate in a clean world and remain committed  to\nthe constitutional ethos and traditions of his calling.\n\n\n\nHEADNOTE:\n    Appointments  to the posts of Second Division Clerks  in\nall  the State Departments of the Karnataka Govt.  are\tgov-\nerned  by the Karnataka Civil Services\t(Ministerial  Posts)\nRecruitment  Rules,  1966 and the power\t to  make  selection\nvests  in the State Public Service Commission. Each  Depart-\nment  notifies\tthe number of required posts to\t the  Public\nService\t Commission and the Commission after  following\t the\nprescribed  procedure  selects persons. The said  Rules\t are\nmade applicable to the judicial department also by statutory\nRules  called the Karnataka Subordinate Courts\t(Ministerial\nand  other posts) Recruitment Rules, 1977. Contrary  to\t the\nsaid  statutory Rules by Notification dated  29.5.1978,\t the\nHigh  Court of Karnataka invited applications for the  posts\nof  40\tSecond Division Clerks and 25 posts of\tTypists\t and\nTypists-copyists in the establishment of the High Court. The\nnotification  stated that the selection would be to fill  up\nthe  then existing posts and for preparing a  waiting  list.\nLarge number of candidates including the appellants  submit-\nted  their applications. The then Chief Justice of the\tHigh\nCourt  appointed  as many as 398 candidates  as\t against  40\nposts advertised; he retained 56 on the establishment of the\nHigh Court and the rest were transferred to the\t subordinate\ncourts.\t These appointments were made during the years\t1980\nto September 1982.\n    In\t1983 seven persons who had applied for the pests  in\nresponse  to  the advertisement dated 29.5.1978,  moved\t the\nHigh Court by means of writ petitions challenging the valid-\nity of all the aforesaid appointments. They urged that\tthey\nhad better merit than the appointees and the\n553\nappointments  made  by the Chief Justice from time  to\ttime\nwithout considering their case was arbitrary and in  deroga-\ntion  of  the rules of recruitment. The High  Court  by\t its\norder date 21.1.1988 allowed the writ petitions and  quashed\nthe  appointments.  The affected persons  filed\t a  petition\nbefore this Court against the order of the High Court  which\nwas dismissed by this court with certain directions so\tthat\nthe petitioners could, as far as possible be absorbed.\n    The\t Petitioners however being dissatisfied,  filed\t the\ninstant\t review\t petitions on the plea that  the  directions\nissued by this Court are not likely to ensure to the benefit\nof  a large number of petitioners, as majority of  them\t had\nalready\t crossed the age of 40 years and thus would  not  be\nable  to avail of the benefit of age relaxation\t under\tRule\n6(3)(b)\t of the Karnataka Civil Services  (General  Recruit-\nment) Rules 1977, that they had put in more than 10 years of\nservice\t and that it would cause them irreparable injury  if\nthey  are  thrown out of employment at that stage  of  their\nlife, as they are not likely to come anywhere near the\tzone\nof selection in the event of fresh selection.\n    This Court admitted the review petition after notice  to\nthe  Respondents,  granted  special leave  to  appeal  after\nrecalling  its earlier order dated 30.4.1990;  and  allowing\nthe resultant appeals,\n    HELD:  The judiciary is the custodian of  constitutional\nprinciples  which  are essential to the maintenance  of\t the\nrule  of law. It is the vehicle for the protection of a\t set\nof  values  which  are an integral part of  our\t social\t and\npolitical philosophy. Judges are the most visible actors  in\nthe administration of justice. Their case decisions are\t the\nmost  publicly\tvisible outcome. But the  administration  of\njustice\t is  just not deciding disputed cases.\tIt  involves\ngreat  deal  more than that. Any realistic analysis  of\t the\nadministration\tof  justice  in the Courts  must  also\ttake\naccount\t of the totality of the Judges behaviour  and  their\nadministrative\troles.\tThey  may appear to  be\t only  minor\naspects\t of the administration of justice, but\tcollectively\nthey are not trivial. They constitute a substantial part  of\nthe mosaic which represents the ordinary man's perception of\nwhat the courts are and how the judges go about their work.\n    The\t Chief Justice or any other Administrative Judge  is\nnot  an\t absolute ruler. Nor he is a free-wheeler.  He\tmust\noperate in the clean world of law, not in the  neighbourhood\nof sordid atmosphere. He has a duty to ensure that in carry-\ning out the administrative functions, he is actuated by same\nprinciples and values as those of the Court he is\n554\nserving.  He cannot depart from and indeed must remain\tcom-\nmitted\tto  the constitutional ethos and traditions  of\t his\ncalling.  Those who are expected to oversee the\t conduct  of\nothers,\t must  necessarily  maintain a\thigher\tstandard  of\nethical and intellectual rectitude. The public\texpectations\ndo not seem to be less exacting.\n    The circumstances of the instant case, however,  justify\na  humanitarian approach and indeed, the appellants seem  to\ndeserve justice ruled by mercy.\n    <a href=\"\/doc\/962160\/\">Lila  Dhar\tv.
