Heard learned  counsel  for  booth\t the<br \/>\nparties.\n<\/p>\n<p>     Second defendant  is the appellant. Suit for partition,<br \/>\nseparate  possession   and  profits   instituted  by\t the<br \/>\nplaintiff_first\t respondent    has  been  decreed    by\t the<br \/>\nappellate Court\t with the  following shares  plaintiff 1\/12,<br \/>\nfirst defendant\t 5\/12 and  second defendant  6\/12. The\tHigh<br \/>\nCourt has  modified the said shares in the following manner:<br \/>\nplaintiff 1\/12,\t first defendant  7\/12 and  second defendant<br \/>\n4\/12. Since  fils share\t has been reduced by the High Court,<br \/>\nthe present has been preferred by the second  defendant .\n<\/p>\n<p>     One Atmaram,  who died on January 13,1971,had two wives\n<\/p>\n<p>&#8211; Janki\t Bai and  Rama Bai. Plaintiff Indira Bai and the 4th<br \/>\ndefendant latya\t are the  children by  Janaki  Bai.  Whereas<br \/>\nfirst defendant Krishna and second defendant Baliram are the<br \/>\nsons through  Rama Bai. Rama Bai was alive when the suit was<br \/>\ninstituted and\tshe was\t impleaded as  the third  defendant.<br \/>\nPending the  suit Rama\tBai died and defendants 1 and 2 -her<br \/>\nsons &#8211;\thave been  impleaded as\t her legal  representatives.<br \/>\nThis  was   done  notwithstanding  the\tplea  of  the  first<br \/>\ndefendant  Krishna   that  Rama\t Bai  has  executed  a\twill<br \/>\nbequeathing her\t entire interest   in  his favour  aline. In<br \/>\nthis appeal  we are  not concerned  with the  shares of\t the<br \/>\nplaintiff and defendants 1 and 2. Here again the plaintiff&#8217;s<br \/>\nshare at  1\/12 is  not in  dispute. The\t dispute  really  is<br \/>\nbetween\t defendants   1\t and  2.  The  appellate  court\t had<br \/>\ndetermined the\tshares\tof  defendant  1  and  defendant  2,<br \/>\nkeeping aside  the will relied upon the first defendant . On<br \/>\nthe other hand, the High Court has accepted the will as true<br \/>\nand accordingly\t modified the shared of these two defendants<br \/>\nas 7\/12 and 4\/12 respectively.\n<\/p>\n<p>     In our  opinion, the  High Court  was not\tjustified in<br \/>\nmodifying the  shares as  aforesaid . Firstly, the will said<br \/>\nto have\t been executed\tby Rama\t Bai in\t favour of the first<br \/>\ndefendant was  not in  issue in\t the suit  nor in  the\tL.R.<br \/>\napplication and\t no finding  with respect  to its  truth and<br \/>\nvalidity has  been recorded.  Notwithstanding the said will,<br \/>\nboth the  brothers defendants  1 and 2 were impleaded as the<br \/>\nL.Rs. of  Rama Bai  . Moreover, since the first defendant is<br \/>\nseeking to  alter the  normal rule  of succession by putting<br \/>\nforward the said will, the burden lies upon him to establish<br \/>\nthe truth and validity of the will.\n<\/p>\n<p>     For the  above reasons,  we set  aside the judgment and<br \/>\ndecree of the High Court and restore the judgment and decree<br \/>\nof the\tfirst Appellate\t Court. It   is, however, made clear<br \/>\nthat it\t shall be  open to  the first defendant to establish<br \/>\nthe truth  and validity\t of the\t said will in an appropriate<br \/>\nsuit\/proceeding in  which event, it is obvious, the inter se<br \/>\nshares as  between the\tpresent defendants  1  and  2  shall<br \/>\ndepend the  finding of\tcompetent court\t regarding the truth<br \/>\nvalidity of the will.\n<\/p>\n<p>     The second\t appeal is  accordingly allowed in the above<br \/>\nterms.
