JUSTICE GOVIND MATHUR\n\n      Mr Deepak Bohra, for the petitioner\/s.\n      Mr Hemant Choudhary, for the respondents.\n                               ...\n\n\n      The petitioners by this petition for writ are claiming family\n\npension and all other death-cum-retiral benefits being heirs of late Sh.\n\nDharmendra Barath, who died while in service of Panchayat Samiti-\n\nJaisalmer on 24.10.1994.\n\n\n\n\n      In brief facts of the case are that Sh. Dharmendra Barath faced\n\nprocess of selection for appointment as Teacher Gr.III under Rajasthan\n\nPanchayat Samiti and Zila Parishad Service Rules, 1959. Though\n\nselected, appointment was not accorded to him by creating some doubt\n\nregarding the educational qualifications possessed by him, i.e. Higher\n\nSecondary School Examination from the Board of Secondary Education\n\nBhopal, Madhya Pradesh. Being aggrieved by the same Sh. Dharmendra\n\nBarath preferred a petition for writ before this Court, wherein an\n\ninterim order was passed in following terms:\n\n\n              \"In the meanwhile respondents may provisionally\n       appoint petitioner on the post of Teacher Gr-III provided\n       petitioner files written undertaking before Deputy\n                                     2\n\n        Registrar of this Hon'ble Court that in case Ann-1 is not\n        found to be genuine he shall reimburse the respondents\n        all the salaries and allowances drawn by him alongwith\n        interest @ 24% p.a. It is clarified that the respondents\n        shall free to carry on verification of said Annexure-1.\"\n\n\n      The respondent, Vikas Adhikari, Panchayat Samiti- Jaisalmer\n\nunder the instructions of Chief Executive Officer cum Secretary, District\n\nEstablishment Committee, Zila Parishad, Jaisalmer dated 9.12.1992\n\naccorded appointment to late Sh. Dharmendra Barath under an order\n\nNo.P.S. Jaislamer\/Education\/Appointment-1992-93.        The appointment\n\nof Sh. Barath was made on probation for a period of two years in pay\n\nscale of Rs.1200-250.    The appointment of Sh Barath was subject to\n\nverification of qualification possessed by him. Unfortunately, Sh. Barath\n\nwhile working as Teacher Gr.III died on 24.10.1994. The present\n\npetitioners being legal heirs of late Sh. Barath by this petition for writ\n\nare claiming family pension and other death-cum -retiral benefits. It is\n\nurged by learned counsel for the petitioner that late Sh. Dharmendra\n\nBarath was working with Panchayat Samiti - Jaisalmer in regular\n\ncapacity, and therefore, the petitioner No.1 being his widow and the\n\npetitioners No.2 and 3 being his children are entitled for family pension.\n\n\n\n\n      A reply to the writ petition has been filed by the respondents\n\nstating therein that the appointment of Sh. Dharmendra Barath was not\n\nregular, therefore, family pension as per Rule 268-B(i) of the Rajasthan\n\nService Rules is not admissible. It is asserted by the respondents that\n                                     3\n\nthe qualification possessed by the petitioner was not verified by the\n\nPanchayat Samiti, and as such, no entitlement is there in favour of\n\npetitioners for receiving family pension.\n\n\n\n\n      Heard counsel for the petitioners and examined the record\n\navailable.\n\n\n\n\n      Late Sh. Dharmendra Barath claimed appointment as Teacher\n\nGr.III being selected as a consequent to regular process of selection. The\n\nrespondents at their own questioned genuineness of the certificate\n\nsubmitted by late Sh. Dharmendra Barath relating to his qualification.\n\nThe decision of the respondents was challenged by late Sh. Dharmendra\n\nBarath by way of filing a petition for writ. True it is, that this Court\n\ngranted an interim direction to the respondents to employ Shri\n\nDharmendra Barath, however, the order of appointment no where refers\n\nthat appointment was given to him in pursuant to interim order. The\n\nappointment to late Sh. Barath was given as per Rule 25 of the\n\nRajasthan Panchayat Samiti and Zila Parishad Service Rules, 1959 and he\n\nwas kept on probation     for a period of two years. The appointments\n\nunder Rules 25 of the Rules of 1959 are regular appointments and the\n\nsame can not be treated as irregular merely on the count that some\n\nverification was required to be made by the respondents. Pertinent to\n\nnote here that so far as late Sh. Dharmendra Barath is concerned he by\n                                     4\n\nway of filing a writ petition before this Court reiterated that whatever\n\nqualification possessed by him was genuine and recognized for all\n\npurposes including for appointment of Teacher Gr.III as per the Rules of\n\n1959. The verification of the qualification was required to be made by\n\nthe respondents, and no such verification is yet made.              If the\n\nrespondents were having any doubt about the qualification possessed by\n\nlate Sh. Dharmendra Barath, they should have acted diligently in this\n\nregard, specially in the circumstances that the person concerned not\n\nonly reiterated genuineness of the certificates produced by him by way\n\nof filing a petition for writ but also submitted an undertaking that in the\n\nevent of being found the certificate forged he will face all\n\nconsequences.    The respondents should have acted promptly at least\n\nafter death of Sh Dharmendra Barath and on receiving claim of the\n\npresent petitioner for pension.         The    respondents should have\n\nunderstood that a claim for family pension warrants very prompt\n\ndisposal being relating to source of survival and livelihood of the wards\n\nof a deceased government servant. If the respondents are not having\n\nsuch sensitivity to understand expediency of a family pension case, this\n\nCourt is left with no option but to draw an inference that whatever\n\nqualification was with Sh. Dharmendra Barath, that was adequate and\n\ngenuine to be appointed as Teacher Gr.III.           As said above, the\n\nappointment given to late Sh. Barath was regular as per the Rule 25 of\n\nthe Rules of 1959, and as such, the petitioners are entitled for family\n                                               5\n\n          pension as per provisions of Rule 268-B(i) of the Rajasthan Service Rules.\n\n          No just and valid reason is available with the respondents to deny family\n\n          pension and all other death-cum-retiral benefits to the petitioners being\n\n          legal heirs of late Sh. Dharmendra Barath.\n\n\n\n\n                Accordingly, this petition for writ is allowed. The petitioners are\n\n          declared entitled to receive family pension and all other death-cum-\n\n          retiral benefits being legal heirs of late Sh. Dharmendra Barath. The\n\n          respondents are directed to extend the benefits as aforesaid to the\n\n          petitioners within a period of three months from today. They are also\n\n          required to pay the arrears accruing in favour of the petitioners within\n\n          the period aforesaid.
