HEMA, J.\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A.No. 5184 of 2008\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 3rd day of September,2008\n\n                                 O R D E R\n<\/pre>\n<p>       Application for anticipatory bail.\n<\/p>\n<p>       2. The alleged offence is under section 409 IPC. According<\/p>\n<p>to the prosecution, a search was conducted in the Touring Book<\/p>\n<p>Stall at Kozhikode and certain books, which are intended to be<\/p>\n<p>sold only through the Government depot, were seized. On<\/p>\n<p>questioning employees of the stall, it was revealed that those<\/p>\n<p>books were supplied by petitioners. They also forged certain<\/p>\n<p>documents to make it appear that those books                      were sold to<\/p>\n<p>certain Headmistresses of certain schools. They were questioned<\/p>\n<p>and it was revealed that they had not purchased the books.<\/p>\n<p>       3. Learned counsel for the petitioner submitted that<\/p>\n<p>petitioners are store keepers of Thalassery and Kannur and it is<\/p>\n<p>highly improbable that they will commit of the offence in the<\/p>\n<p>manner alleged. The books are available at any co-operative<\/p>\n<p>societies and it can be purchased by any person and therefore, it<\/p>\n<p>is not necessary that people from Touring Book Stall have to go to<\/p>\n<p>BA 5184\/08                         -2-\n<\/p>\n<p>Thalassery for procuring the same. Even if some loss is caused to<\/p>\n<p>Government, it can be realized from petitioners, if they are found<\/p>\n<p>guilty. Petitioners have absolutely nothing to do with the crime<\/p>\n<p>and they are falsely implicated in the offence.<\/p>\n<p>       4. This application is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that false vouchers are seized from the depot. Some<\/p>\n<p>vouchers which are purported to be issued by the Headmistress<\/p>\n<p>of several schools were seized from the premises of the stores<\/p>\n<p>where petitioners are working.      On questioning the concerned<\/p>\n<p>teachers, it was found that they had not prepared those<\/p>\n<p>documents. Therefore, it is suspected that petitioners prepared<\/p>\n<p>the same. There is also deficit of the books in the store. Apart<\/p>\n<p>from this, search was conducted in the Book stall and persons<\/p>\n<p>were questioned and they had stated that petitioners are<\/p>\n<p>responsible for giving the books to the stall. In such<\/p>\n<p>circumstances, it is not proper to grant anticipatory bail to<\/p>\n<p>petitioners, it is submitted.\n<\/p>\n<p>       5. On hearing both sides, in the nature of the allegations<\/p>\n<p>made and considering the nature of the investigation which may<\/p>\n<p>be required, I find that interrogation of the petitioners will be<\/p>\n<p>required. Since forgery is likely to be revealed, it is essential that<\/p>\n<p>BA 5184\/08                         -3-\n<\/p>\n<p>petitioners are interrogated. Granting of anticipatory bail in an<\/p>\n<p>offence of this nature will adversely affect the investigation.<\/p>\n<p>       Hence the application is dismissed.\n<\/p>\n<\/p>\n<p>                                              K.
