The Deputy Secretary (Vigilance), Public Works Department,\n                       Government of Bihar, Patna.\n                                               -----------\n<\/pre>\n<p>04.   15.9.2011               Petitioner was put under suspension in the year 2007<\/p>\n<p>                  in anticipation of a contemplated departmental enquiry.<\/p>\n<p>                  Chargesheet came to be served on him subsequently in terms of<\/p>\n<p>                  Annexure-6. For a long period of time the enquiry did not<\/p>\n<p>                  proceed and it is only recently that an enquiry officer has been<\/p>\n<p>                  appointed and there is hope of the proceeding concluding in<\/p>\n<p>                  near future as per the stand of the State counsel.<\/p>\n<p>                              The charges read as a whole are serious in nature<\/p>\n<p>                  and therefore, in the interest of administration, the suspension<\/p>\n<p>                  matter should come to its logical end as much time has already<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>      elapsed ever since the petitioner was put under suspension in the<\/p>\n<p>      circumstance which led to framing of a set of charges indicated<\/p>\n<p>      in Anneuxre-6.\n<\/p>\n<p>                  The writ application is disposed of with a direction<\/p>\n<p>      upon the petitioner that he shall render all co-operation in the<\/p>\n<p>      departmental proceeding         and the departmental proceeding<\/p>\n<p>      should proceed preferably day to day so that it is completed<\/p>\n<p>      within a period of sixty days as indicated by the counsel for the<\/p>\n<p>      State in this regard.\n<\/p>\n<p>                  If such an exercise is not completed within the time<\/p>\n<p>      frame, there could be an occasion for the Court to quash the<\/p>\n<p>      suspension and allow the petitioner to rejoin unless there are<\/p>\n<p>      some other orders against him necessitating the continuance<\/p>\n<p>      thereof since a few other criminal cases too have been instituted<\/p>\n<p>      against the petitioner in relation to his official work.<\/p>\n<p>                  The writ application is disposed of with above<\/p>\n<p>      direction on the respondents.\n<\/p>\n<\/p>\n<pre>rkp                                             ( Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Uma Shankar Ram vs The State Of Bihar &amp; Ors on 15 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.768 of 2011 Uma Shankar Ram, son of late Ghur Fekan Ram, resident of village &#8211; Sugahar, P.O.
