Respondents\n\n        Writ Appeal filed under Clause 15 of the Letters  Patent  against  the\norder dated 30.4.2004 passed in Writ Petition No.5255 of 2004.\n\n\n!For appellants :  Mr.  G.Vasudevan\n\n^For respondents:  Mr.  Gnanasekar \n\n\n:JUDGMENT   \n<\/pre>\n<p>(Judgment of the Court was delivered by<br \/>\nThe Honourable The Chief Justice)<\/p>\n<p>        This  writ  appeal  has  been  filed against the impugned order of the<br \/>\nlearned single Judge dated 30.4.2004 passed in Writ Petition No.5255 of 2004.\n<\/p>\n<p>        2.  We have heard the learned counsel for the parties and perused  the<br \/>\nimpugned order.\n<\/p>\n<p>        3.  In the impugned order, the learned Judge has observed as follows:<br \/>\n&#8221; The respondents are directed to give electricity connection by strengthening<br \/>\nthe  existing  transformer available nearer to the premises of the petitioners<br \/>\non payment of necessary amount by the petitioners.&#8221;\n<\/p>\n<p>        4.  In our opinion, it was not proper for the learned  Judge  to  give<br \/>\nsuch a direction.\n<\/p>\n<p>        5.  Ordinarily, the Judiciary should not encroach into the Legislative<br \/>\nor Executive  domain  vide  <a href=\"\/doc\/1024160\/\">Rama.Muthuramalingam vs.  Deputy Superintendent of<br \/>\nPolice, Mannargudi, A.I.R.<\/a>  2005 Madras 1.  There is  a  broad  separation  of<br \/>\npowers under the Constitution and it is not proper for Judges to encroach into<br \/>\nthe sphere  of another organ of the State.  By the impugned order, the learned<br \/>\nJudge, with due respect  to  him,  has  encroached  into  the  domain  of  the<br \/>\nElectricity authorities.    This Court can only direct that the representation<br \/>\nof the writ petitioners in this connection should  be  decided  in  accordance<br \/>\nwith law  by  the authority concerned within a reasonable time.  But the Court<br \/>\nshould not itself take over the functioning of the Executive authority.\n<\/p>\n<p>        6.  In the circumstances we modify the impugned order of  the  learned<br \/>\nsingle  Judge  and  direct  that the authorities of the Tamil Nadu Electricity<br \/>\nBoard shall consider the request of the writ petitioners as prayed for in  the<br \/>\nwrit  petition  within  a  reasonable  time preferably within a month from the<br \/>\nproduction of this order before the authority concerned.  The writ  appeal  is<br \/>\ndisposed off   with   this   direction.
