It was argued by learned counsel, Mr.S.P.Majmudar, appearing<br \/>\n\tfor the appellants that the petitioners had applied for the post of<br \/>\n\tSub-Inspector (Unarmed), Class III, in which the recruitment process<br \/>\n\twas initiated by advertisement dated 14.2.2009. According to that<br \/>\n\tadvertisement, the selection was to be by competitive examination<br \/>\n\theld in two stages, wherein the first stage consisted of physical<br \/>\n\ttest and preliminary examination. It was stipulated in the<br \/>\n\tadvertisement that the candidate would be required to score minimum<br \/>\n\t50 marks out of total 100 marks in the physical test. Thereafter,<br \/>\n\tthe stipulation in that regard was amended by subsequent<br \/>\n\tadvertisement dated 31.5.2009 before which the Gujarat Police<br \/>\n\tSubordinate (Unarmed), Class III, Competitive Examination Rules,<br \/>\n\t2009 had been notified on 18.5.2009 and put in place in exercise of<br \/>\n\tpowers conferred by Clause (b) Section 5 of the Bombay Police Act,<br \/>\n\t1951. Subsequent amendment of the advertisement by the corrigendum<br \/>\n\tdated 31.5.2009, was in confirmity with the aforesaid rules and it<br \/>\n\twas clarified in the corrigendum that the threshold for clearing the<br \/>\n\tphysical test and preliminary examination would be fixed by the<br \/>\n\tRecruitment Board.\n<\/p>\n<p>In<br \/>\n\tview of the above development, there was no room for the argument<br \/>\n\tthat the rules and criteria to be followed in the recruitment<br \/>\n\tprocess were changed or altered during the course of selection<br \/>\n\tprocess or after the advertisement for recruitment. Even otherwise,<br \/>\n\tthat contention does not appear to have been raised before learned<br \/>\n\tsingle Judge, as it appears from the impugned order that the only<br \/>\n\tcontention of the appellants was that subsequent advertisement had<br \/>\n\tcreated confusion in the mind of the appellants. Thus, the<br \/>\n\tappellants appear to be agitating a new issue at the appellate stage<br \/>\n\tand that too is found to have no substance.
