Gouri Shanker &amp; Anr.\nDate of Order               :         5th January, 2009\n                                PRESENT\n           HON'BLE DR. JUSTICE VINEET KOTHARI\n\nMr. G.R. Goyal for the petitioner.\n                               ---------\n\n               Heard learned counsel.\n\n               This revision petition is directed against the order dated\n\n12.8.2008 of the learned trial court whereby the learned trial court\n\nrejected the application of the defendant-petitioner under Order 7\n\nRule 11 holding that merely because the land in question is\n\nagricultural land as per the Jamabandi produced by the defendant, it\n\ncould not be said that the dispute pertained to the revenue law\n\nbecause that would depend upon the nature of controversy involved\n\nin the suit.\n\n               Apparently the controversy pertains to claim of certain\n\nrights under the agreement between the parties to sell the part of\n\nagricultural land which appears to have been claimed to be a colony\n\nknown as Shri Ram Colony, Sri Ganganagar, which would be\n\napparently an abadi land, therefore, it appears that prima facie this is\n\nnot essential that the dispute pertained to revenue law only which\n\ncould be decided by the revenue Court under Section 207 of the of the\n\nTenancy Act. The Civil Court has, therefore, not committed any error\n\nin rejecting the application under Order 7 Rule 11 C.P.C.\n\n               The present revision petition of the defendant is found to\n\nbe devoid of merit. The same is accordingly dismissed.\n\n\n\n                                        [ DR.
