The FAA further<br \/>\ndirected the PIO to give the copy of the documents to the Appellant within 10 days from the<br \/>\nissue of the order.\n<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p>Non-compliance of the FAA&#8217;s order.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Mr. Kailash Sharma<br \/>\nRespondent : Mr. Naresh Pratap, PIO<br \/>\nThe Respondent had provided the information but not given the photocopies of the<br \/>\naccompanying documents. He demanded Rs.42\/- as additional fee for the photocopies on<br \/>\n04\/08\/2009. He had no legal bases for this and he had not provided the information even now. As<br \/>\nper the RTI Act he was duty bound to provide the information free of cost once the 30 days<br \/>\nperiod was over.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The PIO will give the information to the Appellant before 20 October 2009.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the RTI Act.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause<br \/>\nnotice is being issued to him, and he is directed give his reasons to the Commission to show<br \/>\ncause why penalty should not be levied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 12 November 2009 at<br \/>\n12.00pm alongwith his written submissions showing cause why penalty should not be imposed<br \/>\non him as mandated under Section 20 (1).
