M.S.SHAH)<\/p>\n<p>\tIn<br \/>\nthis petition under Article 226 of the Constitution, the petitioners,<br \/>\n claiming to espouse the cause of consumers of gas in the city of<br \/>\nBaroda, both domestic consumers and commercial consumers, challenges<br \/>\nenhancement of price of natural gas being supplied by the respondent<br \/>\n  Vadodara Municipal Corporation. The petitioners have also prayed<br \/>\nfor constituting a committee comprising members of trade and industry<br \/>\nand officers of the Vadodara Municipal Corporation for fixation of<br \/>\nprice of gas being supplied by the Corporation on the basis of no<br \/>\nloss no profit.\n<\/p>\n<p>2.\tThe<br \/>\npetition is opposed by the respondent   Corporation.<br \/>\nAffidavit-in-reply  filed by the Project Officer Gas Department of<br \/>\nthe respondent Corporation on 8.9.1987 in SCA No.4342 of 1987 is<br \/>\nproduced  wherein the Corporation has given the justification for<br \/>\nincreasing the price of gas being supplied to the consumers in the<br \/>\ncity of Baroda. In this petition, the Corporation has  filed<br \/>\naffidavit-in-reply dated 2.4.2007 wherein it is pointed out that the<br \/>\nCorporation has given gas connections to approximately 68,902<br \/>\ndomestic consumers and approximately 2412 commercial consumers as<br \/>\nwell as 31 connections for AC plants and industries. It is stated<br \/>\nthat the Gas Department is providing domestic connections which<br \/>\nconstitutes approximately 95% of the gas being supplied by the<br \/>\nCorporation and they are given continuous 24 hours supply without any<br \/>\nhassle at cheaper rate. It is also stated that the Corporation is<br \/>\nrequired to pay amounts to ONGC from whom the Corporation has been<br \/>\npurchasing gas. ONGC has demanded approximately Rs.77.18 crores<br \/>\nincluding interest upto 31.12.2004. It is also stated that apart from<br \/>\nthe administrative expenses as well as salaries and wages for the<br \/>\nemployees of the Gas Department of the Corporation and apart from the<br \/>\namounts required to be paid towards purchase price to the ONGC, there<br \/>\nis also further demand by the ONGC for increasing the price of gas.<br \/>\nIt is also stated that petitioner No.2   Baroda Sweet  Merchants<br \/>\nand Namkeen Traders Association  and petitioner No.3   Baroda Hotel<br \/>\nOwners&#8217; Association are themselves associations of profit making<br \/>\nunits which constitute only 14% of the consumers of the Vadodara<br \/>\nMunicipal Corporation. It is submitted that the supply of gas is only<br \/>\nto those consumers who willingly entered into contract with the<br \/>\nCorporation and agreed to abide by the terms and conditions of the<br \/>\ncontract. Any consumer, if he so wishes, has option to withdraw from<br \/>\nthe arrangement. The Corporation has also given particulars of income<br \/>\nand expenses of the gas project which indicate that the Corporation<br \/>\nhas very little surplus from these activities since the Corporation<br \/>\nhas also to pay substantial amount to supplier of gas i.e. ONGC which<br \/>\nhas also been claiming increase in price. There is nothing on record<br \/>\nto hold that the price fixed by the Corporation is arbitrary and<br \/>\nunreasonable.\n<\/p>\n<p>3.\tWe<br \/>\nmay also note that in <a href=\"\/doc\/216597\/\">Association of Natural Gas Consuming Industries<br \/>\nof Gujarat vs. ONGC,<\/a> 1983 (2) GLR 1437, a Division Bench of this<br \/>\nCourt had held the fixation of gas price of ONGC to be arbitrary and<br \/>\nunreasonable. The matter was carried in appeal before the Hon&#8217;ble<br \/>\nSupreme Court and in the judgment reported in AIR 1990 SC 1851, the<br \/>\nApex Court reversed the judgment of this Court and inter-alia<br \/>\nobserved that in the case of less vital, but still basic,<br \/>\ncommodities,  where there is a favourable area of operation,<br \/>\n commercial profits  need not be either anathema or forbidden<br \/>\nfruit even to public sector enterprises. It is also held in the said<br \/>\njudgment that ONGC would be  well justified   in supplying gas to<br \/>\nvoluntary contractors at a price which several parties are willing to<br \/>\naccept and which will enable the ONGC to build up a surplus to meet<br \/>\nits manifold requirements.  The surpluses, it should be remembered,<br \/>\nare not to fatten the coffers of a private individual but only to<br \/>\nstrengthen the backbone of the public enterprise.  The aforesaid<br \/>\nobservations would apply with greater force to a public body like the<br \/>\nVadodara Municipal Corporation which is a local self government,<br \/>\nwhich has to discharge several statutory duties, such as providing<br \/>\nbasic amenities and services to the residents in the city.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above discussion, the petition is dismissed.\n<\/p>\n<p>\tIt<br \/>\nwill, however, be open to the petitioners to make a representation to<br \/>\nthe respondent   Corporation regarding increase, if any, of gas<br \/>\nprice in future.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.S.
