\u00a0<br \/>\nMinistry\u00a0of\u00a0Finance\u00a0(Department\u00a0of\u00a0Expenditure)\u00a0dated\u00a029\u00ad08\u00ad2008,\u00a0the\u00a0accepted\u00a0entry \u00a0<br \/>\ngrade\u00a0pay\u00a0of\u00a0Group\u00adB\u00a0cadres\u00a0is\u00a0Rs.\u00a04800\u00a0in\u00a0PB\u00ad2\u00a0and\u00a0after\u00a04\u00a0years\u00a0service\u00a0is\u00a0Rs.\u00a05400\u00a0as \u00a0<br \/>\nnon\u00adfunctional\u00a0grade\u00a0in\u00a0PB\u00ad3.\u00a0\u00a0I\u00a0am\u00a0holding\u00a0a\u00a0Group\u00adB\u00a0Gazetted\u00a0rand\u00a0post.\u00a0As\u00a0such,\u00a0I \u00a0<br \/>\nam\u00a0entitled\u00a0the\u00a0grade\u00a0pay\u00a0of\u00a0Rs.\u00a04800\u00a0with\u00a0effect\u00a0from\u00a001.01.2006\u00a0and\u00a0after\u00a0completion \u00a0<br \/>\nof\u00a04\u00a0years\u00a0in\u00a0the\u00a0grade\u00a0pay\u00a0of\u00a0Rs.\u00a05400\u00a0at\u00a0least\u00a0on\u00a0personal\u00a0basis.\u00a0The\u00a0correct\u00a0position\u00a0as \u00a0<br \/>\nabove\u00a0may\u00a0be\u00a0informed\u00a0under\u00a0RTI.\n<\/p>\n<p>         All\u00a0the\u00a0required\u00a0enclosures\u00a0are\u00a0attached\u00a0for\u00a0your\u00a0study.\u00a0\u00a0I\u00a0am\u00a0remitting\u00a0herewith \u00a0<br \/>\nthe\u00a0prescribed\u00a0fee\u00a0of\u00a0Rs.\u00a010\u00a0(Rupees\u00a0Ten\u00a0Only)\u00a0by\u00a0means\u00a0of\u00a0postal\u00a0order\u00a0as\u00a0required.\u00a0As\u00a0I \u00a0<br \/>\nam \u00a0 due \u00a0 for \u00a0 retirement \u00a0 with \u00a0 effect \u00a0 from \u00a0 31.01.2011, \u00a0 the \u00a0 information \u00a0 may \u00a0 please \u00a0 be \u00a0<br \/>\nprovided\u00a0early.&#8221;\n<\/p>\n<p>\u00a0       Sh.\u00a0R.\u00a0K.\u00a0Thapar,\u00a0Under\u00a0Secretary\u00a0\/\u00a0CPIO,\u00a0replied\u00a0to\u00a0the\u00a0Appellant\u00a0as\u00a0follows:\u00ad<\/p>\n<p>&#8220;(i)    This\u00a0department\u00a0received\u00a0the\u00a0proposals\u00a0from\u00a0Administrative\u00a0Ministry\u00a0on\u00a0their\u00a0file \u00a0<br \/>\nand\u00a0after\u00a0taking\u00a0a\u00a0decision\u00a0the\u00a0same\u00a0is\u00a0returned\u00a0alongwith\u00a0the\u00a0advice.\u00a0Hence,\u00a0this\u00a0Deptt. \u00a0<br \/>\nis\u00a0not\u00a0having\u00a0the\u00a0communication\/notings\u00a0of\u00a0M\/o\u00a0Urban\u00a0Development.\u00a0However,\u00a0a\u00a0copy\u00a0of \u00a0<br \/>\nUO\u00a0Note\u00a0dated\u00a017.05.2010\u00a0of\u00a0this\u00a0department\u00a0for\u00a0not\u00a0agreeing\u00a0to\u00a0the\u00a0upgradation\u00a0of\u00a0pay \u00a0<br \/>\nscale\u00a0of\u00a0the\u00a0post\u00a0of\u00a0superintendent\u00a0is\u00a0enclosed\u00a0herewith.\n<\/p>\n<p>(ii)    As\u00a0per\u00a0the\u00a0Article\u00a02(f)\u00a0of\u00a0the\u00a0RTI\u00a0Act,\u00a02005,\u00a0information\u00a0means\u00a0&#8216;any\u00a0material\u00a0n \u00a0<br \/>\nany\u00a0form&#8217;.\u00a0\u00a0The\u00a0information\u00a0sought\u00a0by\u00a0you\u00a0does\u00a0not\u00a0fall\u00a0within\u00a0the\u00a0ambit\u00a0of\u00a0the\u00a0Section \u00a0<br \/>\n2(f)\u00a0of\u00a0RTI\u00a0Act.&#8221;\n<\/p>\n<p>        Aggrieved\u00a0with\u00a0the\u00a0reply\u00a0the\u00a0appellant\u00a0filed\u00a0an\u00a0appeal\u00a0before\u00a0the\u00a0FAA.\u00a0\u00a0Sh.\u00a0Manoj\u00a0<br \/>\nSahay,\u00a0Director\u00a0(A)\u00a0\/\u00a0FAA\u00a0vide\u00a0his\u00a0order\u00a0dated\u00a03.03.2011,\u00a0reiterated\u00a0the\u00a0reply\u00a0furnished\u00a0<br \/>\nby\u00a0the\u00a0PIO.\u00a0Not\u00a0satisfied\u00a0with\u00a0the\u00a0reply\u00a0the\u00a0Appellant\u00a0has\u00a0filed\u00a0the\u00a0present\u00a0appeal\u00a0before\u00a0<br \/>\nthe\u00a0Commission.\n<\/p>\n<p>        The \u00a0 Appellant \u00a0 concludes \u00a0 his \u00a0 appeal \u00a0 filed \u00a0 before \u00a0 the \u00a0 Commission \u00a0 with \u00a0 the\u00a0<br \/>\nfollowing\u00a0plea:\u00ad<\/p>\n<p>&#8220;Now, \u00a0I\u00a0earnestly \u00a0place \u00a0my\u00a0appeal\u00a0before \u00a0the\u00a0Second \u00a0Appellate \u00a0Authority \u00a0to\u00a0pass\u00a0an \u00a0<br \/>\norder \u00a0and\u00a0impress \u00a0the \u00a0Ministry \u00a0of\u00a0Finance \u00a0to \u00a0furnish \u00a0the \u00a0desired \u00a0information \u00a0on\u00a0the \u00a0<br \/>\napplicable\u00a0entry\u00a0grade\u00a0pay\u00a0to\u00a0Group\u00adB\u00a0Gazetted\u00a0as\u00a0per\u00a0note\u00ad2\u00adpara(x)\u00a0of\u00a0the\u00a0Resolution \u00a0<br \/>\nof\u00a0the\u00a0acceptance\u00a0of\u00a06th\u00a0CPC.\n<\/p>\n<p>        IT\u00a0is\u00a0requested\u00a0that\u00a0my\u00a0appeal\u00a0may\u00a0please\u00a0be\u00a0weighed\u00a0in\u00a0its\u00a0true\u00a0perspective\u00a0and \u00a0<br \/>\nthe \u00a0 concerned \u00a0 authorities \u00a0 may \u00a0 be \u00a0 impressed \u00a0 to \u00a0 send \u00a0 the \u00a0 information \u00a0 \/ \u00a0 reply \u00a0 at \u00a0 the \u00a0<br \/>\nearliest,\u00a0for\u00a0which\u00a0act\u00a0of\u00a0kindness,\u00a0I\u00a0would\u00a0be\u00a0very\u00a0much\u00a0grateful\u00a0to\u00a0you,\u00a0sir.&#8221;\n<\/p>\n<p>       From\u00a0the\u00a0submissions\u00a0made\u00a0by\u00a0the\u00a0Appellant\u00a0and\u00a0his\u00a0pleadings\u00a0it\u00a0is\u00a0clear\u00a0that\u00a0<br \/>\nthrough\u00a0his\u00a0RTI\u00a0application\u00a0he\u00a0is\u00a0seeking\u00a0a\u00a0decision\u00a0from\u00a0the\u00a0Respondent\u00a0regarding\u00a0his\u00a0<br \/>\nentitlement\u00a0to\u00a0Group\u00adB\u00a0grade\u00a0pay\u00a0whereas\u00a0as\u00a0per\u00a0the\u00a0provisions\u00a0of\u00a0the\u00a0RTI\u00a0Act,\u00a0the\u00a0<br \/>\nPublic\u00a0authority\u00a0is\u00a0expected\u00a0to\u00a0provide\u00a0information\u00a0as\u00a0it\u00a0exists\u00a0in\u00a0material\u00a0form.\u00a0The\u00a0<br \/>\nCommission\u00a0finds\u00a0no\u00a0infirmity\u00a0in\u00a0the\u00a0replies\u00a0of\u00a0the\u00a0Respondent.\u00a0Requisite\u00a0reply\u00a0available\u00a0<br \/>\non\u00a0record\u00a0and\u00a0permissible\u00a0under\u00a0the\u00a0RTI\u00a0Act\u00a0has\u00a0been\u00a0provided\u00a0to\u00a0the\u00a0Appellant\u00a0by\u00a0the\u00a0<br
