Israil, son of Sabebjan Miyan\n                                               Versus\n                                     The State Of Bihar\n                                             -----------\n<\/pre>\n<p>2.   12.09.2011                  Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                 The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 341, 323, 324, 307 and 379\/34 of<\/p>\n<p>                  the Indian Penal Code.\n<\/p>\n<p>                               Considering that the occurrence took place on<\/p>\n<p>                  account of land dispute and the petitioner has fair antecedents,<\/p>\n<p>                  let the petitioner above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                  by the court concerned to the satisfaction of Chief Judicial<\/p>\n<p>                  Magistrate, Jamui, in connection with Sono (Charkapather) P.S.<\/p>\n<p>                  Case No. 72 of 2011 subject to the following conditions: (i) That<\/p>\n<p>                  one of the bailors will be a close relative of the petitioner, who<\/p>\n<p>                  will give an affidavit giving genealogy as to how he is related<\/p>\n<p>                  with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                  information to the court about any change in the address of the<\/p>\n<p>                  petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                  shall not be released on bail. (iii) That the bailor shall also state<\/p>\n<p>                  on affidavit that he will inform the court concerned if the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse. (iv) That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
