Learned APP waives<br \/>\nservice.\n<\/p>\n<p>2.\t\tThe applicant &#8211;\n<\/p>\n<p>convict who vide judgment and order dated 8\/10\/2008 rendered by the<br \/>\nLd.  City Sessions Judge, Court No. 12, Ahmedabad, in Sessions Case<br \/>\nNo. 197 of 2007 has been convicted for the offences punishable under<br \/>\nsections 304, 498-A etc., of the IPC and sentenced to undergo<br \/>\nimprisonment for 10 years and fine, has  forwarded present<br \/>\napplication through jail seeking temporary bail for period of 21 days<br \/>\non the ground of marriage of his niece.\n<\/p>\n<p>3.\t\tThe jail remark sheet<br \/>\nforwarded with the application by the jail authority reveals that the<br \/>\napplicant convict has undergone 4 years and  6 months in jail. It<br \/>\nfurther transpires that the applicant convict has enjoyed temporary<br \/>\nbail  on two occasions and furlough leave on two occasions and on all<br \/>\noccasions, he surrendered in time before the jail authority.\n<\/p>\n<p>4.\t\tConsidering the facts<br \/>\nand circumstances of the case, the  application is allowed in part.<br \/>\nThe applicant convict is ordered to be released on  temporary bail<br \/>\nfor the period from  27\/11\/2011 to 04\/12\/2011, upon furnishing<br \/>\npersonal bond in the sum of Rs.5,000\/- [Rupees five thousand only]<br \/>\nbefore the jail authority on usual terms and conditions.
