I am satisfied that notice has been taken out in his<\/p>\n<p>proper   address.   It   is   declared   that   notice   to   respondent   No.5   is<\/p>\n<p>duly served.\n<\/p>\n<p>       2.        The 5th  respondent is the owner of an apartment in a<\/p>\n<p>building,   of   which   the   6th  respondent   is   the     builder.       For   the<\/p>\n<p>purpose   of   the   construction   in   question   an   agreement   was<\/p>\n<p>executed between the petitioner, GIC Housing Financing Ltd, and<\/p>\n<p>respondents   5   and   6.     However   no   charge   was   created   on   the<\/p>\n<p>property   by   that   exercise.     Though   a   letter   of   authorisation   for<\/p>\n<p>equitable   mortgage   was   given   with   a   power   of   attorney,<\/p>\n<p>thereafter   a   deed   was   executed   in   favour   of   the   5th  respondent<\/p>\n<p>and she mortgaged that document before the 7th respondent bank<\/p>\n<p>and   obtained   a   loan.     By   deposit   of   that   title   deed,   interest<\/p>\n<p>accrued in favour of the 7th respondent on the land and building in<\/p>\n<p>question.\n<\/p>\n<p><span class=\"hidden_text\">WPC.No.31933\/07                         2<\/span><\/p>\n<p>      3.       Thereafter the petitioner invoked the provisions of the<\/p>\n<p>Revenue   Recovery   Act   and   attached   the   property.     This   was<\/p>\n<p>followed   by   a   recovery   certificate   issued   by   the   Debt   Recovery<\/p>\n<p>Tribunal in favour of the 7th respondent.\n<\/p>\n<p>      4.       On   the   strength   of   the   attachment   under   the   Review<\/p>\n<p>Recovery Act,  there is  no  charge  in  favour of  the  petitioner  that<\/p>\n<p>could be treated as one which would override the rights under the<\/p>\n<p>mortgage   in   favour   of   the   7th  respondent,   on   the   question   of<\/p>\n<p>priorities.   The   petitioner   cannot   have   a   preference   over   the   7th<\/p>\n<p>respondent,   while   the   7th  respondent   may   have  a   preference  on<\/p>\n<p>the   basis   of   the   mortgage.     An   attachment   in   the   course   of<\/p>\n<p>revenue recovery proceedings on the strength of the notification<\/p>\n<p>applying   the   Revenue   Recovery   Act   for   recovery   of   dues   to   the<\/p>\n<p>petitioner   does   not   convert   that   debt   to   be   one   that   would<\/p>\n<p>amount to a prior charge in its favour.  There is no such operation<\/p>\n<p>of law.\n<\/p>\n<p>      5.       I   heard   learned   counsel   for   the   petitioner   and   the<\/p>\n<p>learned counsel for the 7th  respondent in relation to the amounts<\/p>\n<p>involved.\n<\/p>\n<p>      6.       Having   regard   to   the   totality   of   the   facts   and<\/p>\n<p><span class=\"hidden_text\">WPC.No.31933\/07                            3<\/span><\/p>\n<p>circumstances, while repelling the challenge of the petitioner, this<\/p>\n<p>writ petition is disposed of issuing the following directions:\n<\/p>\n<p>       i)      The sale proceedings may continue, however, showing<\/p>\n<p>in the sale proclamation, the amounts that is due to the petitioner<\/p>\n<p>also   by   noting   such   amount,   on   the   basis   of   the   petitioner&#8217;s<\/p>\n<p>affidavit, that would be filed by the petitioner before the recovery<\/p>\n<p>officer.\n<\/p>\n<p>       ii)     The   recovery   officer   would   also   make   a   public<\/p>\n<p>announcement in the presence of any intending bidder regarding<\/p>\n<p>the   revenue   recovery   attachment   which   the   petitioner   has   over<\/p>\n<p>the property and minute such announcement in the proceedings<\/p>\n<p>of the recovery officer.\n<\/p>\n<p>       iii)    Following   that,   if   the   amounts   generated   from   sale<\/p>\n<p>exceeds   the   amount   that   is   due   to   the   7th  respondent,   such<\/p>\n<p>amount   will   be   paid   to   the   petitioner   by   the   recovery   officer   on<\/p>\n<p>the strength of this judgment.\n<\/p>\n<p>       iv)     Petitioner   is   left   with   liberty   to   invoke   all   other<\/p>\n<p>remedies   as   may   be   available   in   accordance   with   law,   for<\/p>\n<p>enforcing the recovery of  dues.\n<\/p>\n<p>                                  THOTTATHIL.B.RADHAKRISHNAN<\/p>\n<p>                                                             JUDGE<\/p>\n<p> sv.\n<\/p>\n<p><span class=\"hidden_text\">WPC.No.31933\/07    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Gic Housing Financing Ltd.
