He further submitted that though it is true<br \/>\n\tthat FIR is lodged in the year 2005 and petitioner was arrested only<br \/>\n\tin September, 2010. Petitioner and victim girl were residing<br \/>\n\ttogether as husband and wife during which period the girl also gave<br \/>\n\tbirth to still born child.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions made, now the charge-sheet is filed, no useful<br \/>\n\tpurpose would be served in detaining the petitioner in custody.\n<\/p>\n<p>Considering<br \/>\n\tthe above prima facie aspects of the matter, I find this is a fit<br \/>\n\tcase for granting bail since charge-sheet is also filed. Under the<br \/>\n\tcircumstances, the applicant is ordered to be released on bail in<br \/>\n\tconnection with C.R. No. I-228 of 2005 registered with Anand Town<br \/>\n\tPolice Station on his furnishing bond of Rs.10,000\/-(Rupees Ten<br \/>\n\tThousand) with one surety of like amount to the satisfaction of the<br \/>\n\tlower Court and subject to following conditions :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute. Application is disposed of accordingly.
