Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/02\/2007\n\n O R D E R\n                         M.SASIDHARAN NAMBIAR,J.\n\n                       --------------------------\n\n                           R.S.A.NO.1149 OF 2006\n\n                       -------------------------\n\n             DATED THIS THE 13th DAY OF FEBRUARY, 2007\n\n\n                                     JUDGMENT\n<\/pre>\n<p>       Appellants are defendants 1 and 3 in O.S.349\/98  on the file of<\/p>\n<p>Munsiff Court, Chavakkad.    First respondent is the plaintiff.   Learned<\/p>\n<p>Munsiff granted a decree for mandatory injunction directing appellants<\/p>\n<p>to demolish new structure constructed by them encroaching into plaint<\/p>\n<p>&#8216;A&#8217;   schedule   property   and   also   to   vacate   the   plaint   &#8216;B&#8217;   schedule<\/p>\n<p>property   within   thirty   days.     Appellants   challenged   the   decree   and<\/p>\n<p>judgment   before   District   Court,   Thrissur.     Learned   Additional   District<\/p>\n<p>Judge confirmed the decree  and judgment and dismissed the appeal.<\/p>\n<p>This   second   appeal   was   filed   challenging   the   concurrent   decree   and<\/p>\n<p>judgment.\n<\/p>\n<\/p>\n<p>       2.     When the appeal was came up on 13.12.06, it was found<\/p>\n<p>that   there   is   no   substantial   question   of   law   is   involved.     Learned<\/p>\n<p>Counsel appearing for appellants then prayed for time to surrender the<\/p>\n<p>building.   On   that   submission   notice   was   issued   to   respondents.<\/p>\n<p>Learned Counsel appearing for respondents opposed granting time.<\/p>\n<p>       3.     Learned Counsel appearing for appellants and respondents<\/p>\n<p>were heard.\n<\/p>\n<p>\n<span class=\"hidden_text\">R.S.A.1149\/06                           2<\/span><\/p>\n<p>       4.    It   was   submitted   by   learned   Counsel   appearing   for<\/p>\n<p>appellants that the children of appellants are studying in school and<\/p>\n<p>till the end of this  academic  year,  appellants may be permitted to<\/p>\n<p>reside in the building and they may be granted time till 31.3.07.  In<\/p>\n<p>the circumstances of the case, appellants are granted time to vacate<\/p>\n<p>the building till 31.3.07.\n<\/p>\n<\/p>\n<p>       Appeal   is   dismissed,   granting   time   to   the   appellants   to<\/p>\n<p>surrender vacant possession of the building till 31.3.07.
