Justice K.T.SANKARAN\n\n Dated :12\/10\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 3667 OF 2009\n             ------------------------------------------------------\n            Dated this the 12th day of October, 2009\n\n\n                                O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioner is accused No.26 in<\/p>\n<p>Crime No.65 of 2005 of Valappad Police Station.<\/p>\n<p>      2.   The offences alleged against the accused persons are<\/p>\n<p>under Sections 143, 147, 148, 341, 323, 324 and 308 read with<\/p>\n<p>Section 149 of the Indian Penal Code.\n<\/p>\n<\/p>\n<p>      3. The case was tried by the Sessions Court. It is submitted<\/p>\n<p>that all other accused were acquitted. The petitioner did not appear<\/p>\n<p>and, therefore, the case against him was split up and it was<\/p>\n<p>numbered as Long Pending Case.\n<\/p>\n<\/p>\n<p>      4. Thereafter, the petitioner entered appearance and he was<\/p>\n<p>B.A. NO. 3667 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>\ngranted bail by the committal court. The learned counsel for the<\/p>\n<p>petitioner submitted that after committal of the case to the Sessions<\/p>\n<p>Court on 21.1.2009, the petitioner could not appear as he was<\/p>\n<p>working abroad. Though an application was filed on his behalf for<\/p>\n<p>condoning absence, the learned Sessions Judge dismissed that<\/p>\n<p>application, submits the counsel.       Now, non-bailable warrant is<\/p>\n<p>issued against the petitioner. The petitioner apprehends arrest.<\/p>\n<p>       5. <a href=\"\/doc\/876043\/\">In Vineeth Somarajan v. State of Kerala<\/a> (2009 (3) KHC<\/p>\n<p>471), it was held that where non-bailable warrant is issued by the<\/p>\n<p>court on account of non-appearance of the accused, the remedy of<\/p>\n<p>the accused is to file an application for withdrawal of the warrant and<\/p>\n<p>for the grant of bail. It was also noticed in that decision that when<\/p>\n<p>such an application for bail is filed, the learned Magistrate has to<\/p>\n<p>dispose of the Bail Application taking into account the principles laid<\/p>\n<p>down in <a href=\"\/doc\/1362546\/\">Biju v. State of Kerala<\/a> (2007(2) KLT 280).<\/p>\n<p>       Reserving the right of the petitioner to apply before the<\/p>\n<p>Sessions Court for withdrawal of the warrant and for the grant of bail,<\/p>\n<p>this Bail Application is closed.
