No.5872\/2010-H\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n          Dated this the 23rd day of February, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner is a student of third respondent-College<\/p>\n<p>in M.Com course.  The examination for the first year M.Com<\/p>\n<p>commenced on 10\/02\/2010.    The petitioner was denied hall<\/p>\n<p>ticket on the ground that she did not secure minimum marks<\/p>\n<p>for admission to M.Com and she is short of 0.07% of marks<\/p>\n<p>which is necessary for securing admission.  The petitioner<\/p>\n<p>has acquired 42.93% in the B.Com degree course.   According<\/p>\n<p>to the petitioner, no cut off marks or minimum eligibility<\/p>\n<p>marks for admission to M.Com has been stipulated by the<\/p>\n<p>University.\n<\/p>\n<p>    2.   Going by Ext.P3 letter, the college authorities<\/p>\n<p>have communicated to the Controller of Examination that<\/p>\n<p>even though the petitioner has secured only 42.93% of<\/p>\n<p>marks, the admission Board considered it as 43% and granted<\/p>\n<p>admission to M.Com as she belongs to OBC.   The petitioner<\/p>\n<p>is aggrieved by the denial of the opportunity to write the<\/p>\n<p>examination and hence, by Ext.P4 she has approached the<\/p>\n<p>Vice Chancellor in the matter.\n<\/p>\n<p>    3.   The learned counsel for the petitioner prayed for<\/p>\n<p>a direction to the Vice Chancellor to take a decision on<\/p>\n<p>W.P.(C). No.5872\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>Ext.P4 within a time frame and allow the petitioner to<\/p>\n<p>continue the course in the meanwhile.<\/p>\n<p>     4.      Heard the learned counsel for the petitioner and<\/p>\n<p>the learned Standing Counsel for the University.<\/p>\n<p>     5.      There will be a direction to the Vice Chancellor<\/p>\n<p>of the University to take a decision on Ext.P4 with notice<\/p>\n<p>to the petitioner within a period of one month.       In the<\/p>\n<p>meanwhile, the petitioner will be permitted to continue the<\/p>\n<p>course by the third respondent-College.<\/p>\n<p>     The writ petition is disposed of as above.
